HomeMy WebLinkAbout00002225City of DEPARTMENT OF COMMUNITY SERVICE Division of Building and Code Smlic;� VS VIA CERTIFIED MAIL July 1, 2008 Leisure Warehouse 4014 W, '96'h Street Indianapolis, IN 46268 RE: ZONING ORDINANCE VIOLATION —TEMPORARY SIGN(S) Dear Sir or Madam: This letter is being provided to inform you that temporary signs and outdoor sales/temporary use violations have been brouqht to this department's attention, The signs and outdoor sales products are located at 4014 W. 96" Street under the zoning jurisdiction of the City of Carmel, a property that you are currently a tenant of. BUSINESSES ARE NOT PERMITTED TO DISPLAY TEMPORARY SIGNS, regardless of whether or not the sign is located on thebusiness's premises. According to Section 25.07.01-4 Prohibited Signs, of the Carmel/Clay Zoning Ordinance the following sign(s) are prohibited: (f) Signs consisting of banners, posters, pennants, ribbons, streamers, strings of light bulbs, spinners or similar devices, unless they are permitted specifically by other sections of this Ordinance. Also, the Carmel/Clay Zoning Ordinance also states in section 25.22.01 Sales, Outdoor, Temporary 'Use that: Outdoor Sales shall only be permitted in the zoning districts as per Appendix A: Schedule of Uses, such uses shall be allowed only as a Temporary Use, requiring a Temporary Use Permit. This letter shall serve as the first and final warning for this type of violation. Please remove the: illegal signs and permanently store all merchandise within the facility, as you do not have an approved Temporary 'Use, Permit for the temporary outdoor sales of merchandise no later than July 11, 2008. Should you continue to be in violation of these ordinances after this date, you may be subject to further enforcement action including! a possible court appearance.
