Our August letter noted that the City required a cure of the violation by no later than October 1, 2007. As of this letter we have not received notification from National City that the violations have been cured, and thus, we can only assume they remain in effect. If we have not heard from National City Bank no later than November 9, 2007 with a scheduled plan of action to relieve this violation, it is the Landlord's intention to bring the landscaping into cure with the City -approved drawings as soon as possible thereafter, and all fees related to resolving these violations will be back -charged to the Tenant.
