Cap the sides, of the awning over the Drive-thru window to make it consistent with the plans that were submitted and approved by the Plan Commission and the plans that were submitted for building permit review. Change, the Coping Color to be consistent with the Benjamin Moore "Night Shade" which was presented and approved by the Plan Commission rather than the Benjamin Moore "Festive Orange" that was installed. Change the Monolith Color to be consistent with the Benjamin Moore "Night Shade" which was submitted on plans and approved by the Plan Commission rather than the Benjamin Moore "Festive Orange" that was installed. 0 Jeffery a. Range Line Road, Carmel, IN Dear Ms. Boone, Per conversations with you and your office, it has come to our attention that the awnings and coping colors on the Dunkin Donuts at 1305 S. Range Line Road do not match what was approved by the planning commission on March 6, 2007. As stated in these conversations, the "orange" that was installed is too bright and vibrant and the commission desires amore toned down "rust" color for both the awnings and the upper coping color. After much searching, I believe we have found an awning color match for the "rust" that was approved. The awning contractor, Thorpe Awnings, will present a sample to your office for review,. The coping colors will be painted to match the approved drawings. The "orange" will be painted "rust" and the monolith will be painted "night shade" as originally indicated on the drawings. I believe that both tasks will be completed within 6 weeks. When we have solid installation dates, from the contractors, I will update you. Cc: Hollibaugh, Mike P subject: Fw: Dunkin Donuts Angie: Here is a copy of mg previous email. once again, let me explain that in our meeting with Mr. Humphrey, he brought the material sample boards that were presented at the March 2007 meeting of the special Studies Committee. The color shown as the "Awning and Coping" color on the material sample boards was Benjamin Moore "Rust". The color written on the plans and the color that was used on the building was the Benjamin Moore "Festive Orange". Also, we asked Mr. Humphrey to go ahead and just change the awning and coping colors to be the darker shade and to paint them to match and he indicated that he unwilling to bear that expense at this point. Therefore, he was informed that his only other option was to take the facade before the Plan Commission to have it approved and to amend his ADLS, since he clearly did not build the facade to the elevations that the Plan Commission approved. so, he indicated that he would be filing another ADLS Amendment and intended to go before the Plan commission Committee again on November 1, 2007 for approval of the elevations as they currently exist and/or for direction on how he should proceed with making changes to the facade to be acceptable to the Plan Commission. Laura From: DeVore, Laura B Sent: Tuesday, October 02, 2007 11:07 AM To: Hollibaugh, Mike P; Holmes, Christine B; Boone, Rachel M.; Brennan, Kevin S subject: Dunkin Donuts After digging through the ADLS Amendment file and the Building Permit file, there are several discrepancies between the elevations submitted for the Plan commission approval, the building permit approval and then what was actually built. The most apparent discrepancies include: 1.) Door Location: On the elevations submitted for the Plan Commission approval, the door is never indicated to be on the right side of the west Elevation next to the drive thru lane. That change happened with the submission of plans for the building permit approval. 2.) Coping colors: The Plan Commission -a proved elevations read that the coping color will be all the Benjamin Moore "Night shade". visually, however, those plans show the coping color matching the awning color on all sections except for the brick "entry feature (which is no longer an entry element) which shows the coping being the darker color to correspond with the brick work. Page 1 Email --Dunkin Donuts 3.) Awnings: The 'awnings were apparently (from negotiation) supposed to be closed on the ends. The Plan Commission file only shows the awning over the drive thru window as being closed. The existing awning over the drive thru is not closed. However, the Plan commission plan does indicate that the awnings that say "Bake Place" and "Drive thru" should create a larger gap of approximately four feet. This gap would help to break up the plane of the facade and help to reduce the intensity of the color somewhat. It seems, however, that the gap was eliminated when the door location was moved. 4.) Awning Color: Though the current color of the awnings match the color that was written on the plans, the March 6, 2007 minutes of the special studies committee indicate that Marsha Butkovich, of 7effrey A. Scott Architects for Dunkin Donuts said that "The awningg color is a toned -down orange —burnt orange and has more brown tones." Again, the fact that they eliminated the four -foot gap that was originally presented only intensifies the color problem. To get everyone on the same page prior to the meeting on Thursday, it is my opinion that we give Mr. Humphrey the following options: 1.) Change the coping colors to match the awning color and repaint the coping on the former "entry element" to match the Benjamin Moore "Night shade" as was visually presented to the Plan Commission. and 2.) Change the awning color to be a more earthy, burnt orange or rust color and correspond the coping painting to match it. Or 1.) Go before the Plan commission again to amend the ADLS to match the changes as submitted for building permit review. Does anyone have any questions about the discrepancies?
