Carmel, Indiana 46033 RE: ZONING ORDINANCE VIOLATION Dear Sir or Madam: This letter is being provided to inform you that our department has recently received some concerns regarding 11318 Lakeshore Dr. E. in the City of Carmel, a property listed under your ownership/tenancy. Upon inspection, a fire -pit was observed to be built between the fence (on the property line) and a deck. This fire -pit is considered an accessory building/structure/use, and its current placement is in violation of Cannel/Clay Land Use Ordinance §- 25.01 Accessory Buildings and Uses, and specifically § 25.01 (B) (b) Minimum Side and Rear Yards: i. When more than ten (10) feet from a Principal Building, Accessory Buildings shall be set back a minimum of the greater of the following: (a) Five (5) feet (from the property line), or, (b) Easement plus three (3) feet, but not within any Easement or required landscaped or greenbelt area. Engineering states the placement also interferes with the Easement flow of water runoff drainage from the property. Please move the fire -pit to an area within the Carmel/Clay Land Use provisions, or remove the fire -pit by August 14, 2008. Failure to do so can and will result in further enforcement action by the City of Carmel to include daily citations until the violation is corrected, or the fire -pit may be removed by the city, in which the owner of the property will be billed for such action.
