Ste. 100 Carmel, Indiana 46032 RE: CITY CODE VIOLATION - HAZARDOUS TREE/DEBRIS Dear Sir / Madam: This letter is being provided to inform you that a complaint was made to the Department of Community Services regarding a possible City Code Violation at 0 Aquamarine Dr. (directly behind 5662 Aquamarine Dr. in the buffer/common area) in the City of Carmel, a property listed under your ownership. An inspection revealed that a large tree has split and the debris is resting in the common area/buffer area. This violates the Carmel City Code 56-77(k), which construes the following conditions to be public health nuisances: (k) Any accumulation of junk, rubbish, scrap metal, automotive parts, building materials, machinery, deadtrees, orparts thereof, upon any premises in a residential area. And, and §6-76; Pt<blic Nuisances Defined. A public nuisance is a thing, act, occupation, condition or use of property which shall continue for such length of time as to: (a% Substantially annoy, injure or endanger the comfort, health, repose or safety of the public; or %6 In any way render the public insecure in life or in the use of property. Please be advised, if the above referenced violation is not corrected within by July 30, 2008, the City of Carmel may bring this matter into compliance. You, as property owner(s) will be liable for and billed for the cost of correcting the violation and all administrative costs. The city of Carmel Urban Forester, Daren Mindham, also inspected the property and recommended that the entire remaining standing tree be brought down as well.
