RE: CARMEL CITY CODE: WEEDS & GRASS/ PROPERTY MAINTENANCE
;Dear Sir or Madam:
This letter is being provided to inform you that the property at 750 First Ave. NW., a
property list under your ownership, 'is in violation of Carmel City Code § 6-88, (Ordinance
No. D-1557-02) and Indiana Code §3&1-3-6 (b)(1).
(c) Requirement to cut. All owners of real property ("property") located
within the City shall cut and remove weeds and other rank vegetation
growing thereon that exceeds an average height of six inches, and shall
keep their property clear of debris.
This property is also in violation of Carmel City Code §6-2210, the Property
Maintenance Code. The following are the sections of code in violation,:
(1) §6-222 (a)4 Vacant structures and land. All vacant structures and premises
thereof or vacant land shall be maintained in a clean, safe, secure, healthful
and sanitary condition as provided herein so as not to cause a blighting
problem or adversely affect the public health or safety or violate the provisions
of this Code.
(2) §6-222 (c) 6 Roofs and drainage. The roof and flashing shall be sound, tight
and not have defects that admit rain. Roof drainage shall be adequate to
prevent dampness or deterioration in the walls or interior portion of the
structure. Roof drains, gutters and down spouts shall be maintained in good
repair and free from obstructions. Roof Drain discharges shall be discharged
as a Legal Connection or a Legal Discharge. Inappropriate or temporary
roofing coverings including but not limited to tarps shall be deemed inadequate
protection and not uniform and as such shall be prohibited for a period
exceeding seven (7) consecutive days.
(3) §6-222 (c) I General. The exterior of a structure shall be maintained in good
repair, structurally sound and sanitary so as not to pose a threat to the, public
health, safety or welfare.

(4) §6-222 (c) 2 Protective Treatment. All exterior surfaces, including but not
limited to, doors, door and window frames, cornices, porches, trim, balconies,
decks, and fences shall be maintained in good condition. Exterior wood
surfaces, other than decay resistant woods, shall be protected from the
elements and decay by painting or other protective covering or treatment.
Peeling, flaking and chipped paint shall be eliminated and surfaces repainted.
All siding and masonry joints as well as those between the building envelope
and the perimeter of windows, doors, and skylights shall be maintained
weather resistant and water tight. All metal surfaces subject to rust or corrosion
shall be coated to inhibit such rust and corrosion. Oxidation stains shall be
removed. All exterior surfaces shall be of uniform colors and materials to
ensure compatibility with adjoining properties.
The structure lacks gutters and downspouts that are necessary for roof discharge, and
these are required to be added to the structure. The property is to be maintained at all
times. All exterior surfaces that have chipping, loose, or missing paint shall be made water
proof and weather tight.
Please be advised, the high weeds and grass ("requirement to cut") violation is not
corrected within seven (7) days (May 20, 2008) from the date of this letter this matter
will be brought into compliance by the City of Carmel. You, as property owner(s) will be
liable and billed for the cost of correcting the violation and all administrative costs.
Violations of the Property Maintenance Code must be addressed by June 20, 2008. If
these matters are not addressed, you as the property owner will be subject to daily
citations and/or summoned to court. If you have any questions, please contact me at 571-
