Baine 510 Rangeline Rd. S. Carmel, Indiana 46032 RE: ORDINANCE VIOLATION — PROHIBITED USE/SIGNS/DISPLAY OF GOODS Mr. Baine: This letter is being provided to inform you that our department has recently received several concerns regarding 510 Rangeline Rd. S. in the City of Carmel, a property listed under your ownership. This property is located in the Carmel Drive — Range Line Road Overlay Zone (Chapter 2317) which does not permit for the sale of automobiles as stated in City of Carmel Zoning Ordinance §23F.04.02 (Prohibited Uses: Appendix A — Schedule of Uses). §23F.04.02 Prohibited Uses. A. Automobile, Truck, Boat, Mobile Home, Manufactured Housing or RV Sales. Additional concerns are the business signage and merchandise being displayed in the City of Carmel Right -of -Way. The Carmel Zoning Ordinance, Land Use Regulations, prohibits signs in the right-of-way as outlined in §25.07.01-04(i), and the Carmel City Code prohibits the display of goods for sale on public property as outlined in §6-59: §25.07.01-04 Prohibited Signs. (i) Signs which are located upon, over, or in any street or highway right-of-way except for official highway signs. §6-59 Display of Goods for Sale on Public Property Prohibited. No person shall use any street, sidewalk, or other public place (ie. right-of-way) for the display or sale of goods or merchandise, or write or affix any signs or advertisements on any pavement. Please bring the property into compliance with the Carmel Land Use Regulations (Prohibited Uses) by December 28, 2007. Failure to resolve the violations will result in further enforcement action by the City of Carmel to include the issuance of daily citations.
