RE: CITY CODE VIOLATION —ANIMALS
Dear Ms. Akard:
This letter is being provided to inform you that an inquiry was made to the Department of
Community Services regarding a possible C)ty Code Violation at 392 Aspen Way, in the City of
Carmel, a property listed under your ownkship. An inspection revealed that the concern
appears to be valid and that the property is in violation of the Carmel/Clay Zoning Ordinance as
it relates to the number of pets allowed in a residential home. The following are the 2 definitions
related to this situation:
KENNEL, COMMERCIAL-- Any Lot on which four (4) or more dogs, or small animals, at least
four
months of age are kept.
KENNEL, RESIDENTIAL-- Any Lot on which three (3) or less dogs, or small animals, at least
four
months of age are kept.
As you can see by these definitions, having more than 3 animals in your home is considered a
"commercial kennel" and, therefore, a violation of the zoning ordinance. A variance must be
obtained in order to continue to keep more than 3 dogs on a residential property.
Please bring this property into compliance with the Carmel/Clay Zoning Ordinance by August
10, 2007. Failure to resolve the violation(s) by the specified deadline will result in further
enforcement action by the City of Carmel. If you have any questions or comments regarding
