Steffen 4984 Waterside Circle Carmel, IN 46033 RE: Revocation of Permit No. 07040094 Dear Mr. Steffen: On Saturday, May 19, 2007, your building permit referenced above was revoked by the Department of Community Services of the City of Carmel, Clay Township. At this time, we would like to make you aware of some options regarding this situation. First, if you do not have any intention of building the structure, or a modified version of the project, you are able to apply for a refund of certain portions of the permit fee you paid. The fees available for refund for this permit would be the Certificate of Occupancy cost of $55.50, and the fees for the three (3) inspections that were assessed as required. The inspection fees were assessed as $57.50 each, so the total for those is $172.50. The total amount you can then apply for in a refund request is: $228.00. Attached is our refund request form, should you choose this course of action. If, however, you intend to appeal the decision, or intend to apply for a variance, in order to proceed with the project or a modified version of the project, you could hold off on applying for a refund. If you gained approvals, we could then reinstate the permit. If there were changes to the project from that which was originally approved, we would have you apply for an amendment/revision to the original permit. Mr. Eppink lives right next door to this property and was told by the owner (Steffen) that a pole barn was to be built at the rear of the lot. Mr. Eppink had questions regarding the legality of this proposed barn as well as questions of square footage, height and location on the lot. I told Mr. Eppink that I had become aware of this prior to the permit issuance because our staff also had questions. The questions were answered and we determined that the pole barn was legal in the location on the lot, the height and square footage. Mr. Eppink then informed me that he knew that the house was not as large as the 1890 square feet as the proposed barn was going to be and that we had to investigate this aspect before letting Mr. Steffen build it. I called Mr. Steffen and spoke with him about his property and his future pole barn at great length. I then asked Mr. Steffen to conduct an interior inspection of the house and he said that would be fine. I met Mr. Steffen on Wednesday, May 91h and took a tour of the house. Everything was perfectly fine with the house and it does meet all the criteria required per the ordinance. I spoke with Mr. Steffen for quite a while that morning and discussed the reasons for the pole barn, his intended use (for personal storage of lawn equipment and what he called "man toys") and why he is placing it where he has indicated. Mr. Steffen was quite candid to me in regards to his answers and explained everything he has gone through in order to secure his permit for this pole barn. I then came back to the office and prepared the attached email to staff to inform them all of what has transpired on this property. Since that time I have spoken with Mr. Steffen twice, Mr. Eppink, Doris Segar and Mike Surber regarding this issue today. It appears that a number of neighbors have gathered together to try to oppose this pole barn, but negotiations between the various parties have taken place that might change everything. Mr. Steffen is negotiating with some abutting neighbors to replat his property to be part of the Wind Pointe addition, but is lacking a few feet of property from an adjoining neighbor. A deadline was imposed for tonight to make this happen or the pole barn will be erected just where it has been proposed. Mr. Steffen is within his rights to construct the pole barn, but it will adversely affect his neighbors and their potential property values. I apologize for the length of this, but I felt you needed all of this information since a couple of the citizens has contacted you about this situation. Subject: 11739 Gray Rd --Pole barn--#07040094 Folks, I have completed my investigation of the issuance of this permit and found it factual and completely legal. I met with the owner this morning and inspected the house from top to bottom. They do have 3 floors of approximately 700 sq ft each which corresponds to the information supplied with the application. Whether or not the neighbors appreciate the location of a pole barn near them, there is no violation to consider nor a reason to revoke the permit. Thanks, Kevin May 18, 2007 Mr. Joseph W. Steffen 4984 Waterside Circle Carmel, IN 46033 RE: Revocation of Permit No. 07040094 Dear Mr. Steffen: Pursuant to the authority vested in me by the general ordinances of the City of Carmel, Indiana, I hereby revoke the above referenced permit. This office has determined that the premises on which your proposed barn (or detached garage, as described in your application for an Improvement Location Permit) would be situated constitutes a Double Frontage Lot under Chapter 3 of the Carmel Zoning Ordinance. Pursuant to Section 26.02.01 of the Zoning Ordinance, a front yard or setback must be provided on both adjacent streets, namely Gray Road and Windpointe Pass. Section 5.04.03.A provides for a minimum front yard in the S-1 Residence District of forty (40) feet from the right-of-way of the public streets. In addition, this office has determined that the proposed barn would not conform to the definition of an Accessory Use set forth in Chapter 3 of the Zoning Ordinance, which requires that the Accessory Use be both "subordinate to the main use" and "incidental to the main use" on the same lot. In view of the fact that the barn would not be used in conjunction with the existing residential use (the house situated on the same lot), the barn is determined to be neither "subordinate" nor "incidental" to the main use of the premises. Finally, it is this office's determination that, even if the barn otherwise constituted an accessory building or use, that such building or use would alter or change the residential character of the premises, in violation of Section 25.01.01.A.I of the Zoning Ordinance. Pursuant to Section 30.01 of the Zoning Ordinance, you may appeal this revocation of your permit to the Carmel Board of Zoning Appeals.
