RE: POSSIBLE ZONING ORDINANCE VIOLATIONS
Dear Sir or Madam:
This letter is being provided to inform you that our department has recently received some
concerns regarding 10255 College Avenue in the City of Carmel, a property listed under
your ownership. A recent inspection of the property revealed a swimming pool with
insufficient enclosure. Please be advised that Section 25.01.01 (C) (8) (b) of the
Carmel/Clay Zoning Ordinance states:
b. Safety. For purposes for safety, the following shall apply:
i. Walls or Fencing. Walls or fencing deemed to be
impenetrable by the enforcing authority, that is not less than
five (5) feet high completely surrounding the swimming pool
and the deck area with exception of self -closing and latching
gates and doors, both capable of being locked;
ii. Other Means. Other means not less than five (5) feet high and
deemed impenetrable by the enforcing authority at the time of
construction and completely surrounding the pool and deck
area when the pool is not used; and
iii. Combination. A combination of Subsections (i) through (ii)
that completely surrounds the pool and deck with the
exception of self -closing and latching gates and doors which
are capable of being locked; or
iv. Pool Cover. A safety pool cover may be used provided that:
(a) there is a continuous connection between the cover
and the deck, so as to prohibit access to the pool
when the cover is completely drawn over the pool;
(b) it is mechanically operated by key or key and switch
such that the cover cannot be drawn upon or retracted
without the use of a key;
(c) it is capable of supporting a four hundred (400)
pound imposed load upon a completely drawn cover;
(d) it is installed with a track, rollers, rails or guides;
(e) it bears an identification tag indicating the name of
the manufacturer, name of the installer, installation
date, and applicable safety standards, if any.

(f) that it is in compliance with the Indiana swimming
pool code, 2d Edition, effective date September 13,
1989, as amended.
This concern is an urgent matter, as it represents a public safety and health issue.
Please have the pool secured or removed from the property no later than July 25,
2008.
Our department also sent you a letter on October 18, 2007, that cited your property, which
is zoned residentially (R1), for a possible duplex/multi-family use. As per Appendix A,
Schedule of Uses, of the Carmel/ Clay Zoning Ordinance, a multi -family use is not a
permitted use in this zoning district.
There has been no indication that you have attempted to file for a variance to bring the
site into compliance. Please file for a variance no later than September 12, 2008.
Failure to do so could result in further enforcement action. If you need more information
on the process of filing for a variance, you can contact Planning Administrator, Christine

Dear Sir or Madam:
This letter is being provided to inform you that our department has recently received some
concerns regarding 10255 College Avenue in the City of Carmel, a property listed under
your ownership. The concern cited that a possible duplex/multi-family use exists at this
property, which is zoned residentially (R1). As per Appendix A, Schedule of Uses, of the
Carmel/ Clay Zoning Ordinance (see attached), a multi -family use is not a permitted use in
this zoning district.
This department performed an initial site inspection of the subject property. This letter
shall serve as informational notification of the regulations pertaining to the permitted types
of uses for a residentially zoned property. In order to bring the site into compliance, you
need to file to obtain variance approval from the Board of Zoning Appeals. If you need
more information on the process of filing for a variance, you can contact Planning
Administrator, Christine Barton -Holmes at (317) 571-2417. Failure to bring this site into
compliance could result in further enforcement action.
