RE: CITY CODE VIOLATION — ANIMALS
Dear Ms. Easton:
This letter is being provided to inform you that an inquiry was made to the Department of Community
Services regarding a possible City Code Violation at 6320 Northwood Dr., in the City of Carmel, a
property listed under your ownership. An inspection revealed that the concern appears to be valid and
that the property is in violation of the Carmel/Clay Zoning Ordinance as it relates to the number of pets
allowed in a residential home. The following are the 2 definitions related to this situation:
KENNEL, COMMERCIAL-- Any Lot on which four (4) or more dogs, or small animals, at least four
months of age are kept.
KENNEL, RESIDENTIAL-- Any Lot on which three (3) or less dogs, or small animals, at least four
months of age are kept.
As you can see by these definitions, having more than 3 animals in your home is considered a
"commercial kennel" and, therefore, a violation of the zoning ordinance. You previously obtained a
variance to allow you to keep your pets, but with the provision that you eventually reduce the number to 3
or less or apply for a new variance prior to the expiration of the first one. As I have heard from neighbors
of the number of animals that are being kept in your home I must conclude that you are currently in
violation and I offer you these 2 remedies to the situation:
1) obtain a new variance of use to legally establish your excessive number of pets or
2) remove 4 of the pets from the home permanently.
Please bring this property into compliance with the Carmel/Clay Zoning Ordinance by March 31, 2008.
Failure to resolve the violation(s) by the specified deadline will result in further enforcement action by the
City of Carmel. If you have any questions or comments regarding this matter, please feel free to contact
