Easton 6320 Northwood Dr. Carmel, IN 46033 RE: CITY CODE VIOLATION — ANIMALS Dear Ms. Easton: This letter is being provided to inform you that an inquiry was made to the Department of Community Services regarding a possible City Code Violation at 6320 Northwood Dr., in the City of Carmel, a property listed under your ownership. An inspection revealed that the concern appears to be valid and that the property is in violation of the Carmel/Clay Zoning Ordinance as it relates to the number of pets allowed in a residential home. The following are the 2 definitions related to this situation: KENNEL, COMMERCIAL-- Any Lot on which four (4) or more dogs, or small animals, at least four months of age are kept. KENNEL, RESIDENTIAL-- Any Lot on which three (3) or less dogs, or small animals, at least four months of age are kept. As you can see by these definitions, having more than 3 animals in your home is considered a "commercial kennel" and, therefore, a violation of the zoning ordinance. You previously obtained a variance to allow you to keep your pets, but with the provision that you eventually reduce the number to 3 or less or apply for a new variance prior to the expiration of the first one. As I have heard from neighbors of the number of animals that are being kept in your home I must conclude that you are currently in violation and I offer you these 2 remedies to the situation: 1) obtain a new variance of use to legally establish your excessive number of pets or 2) remove 4 of the pets from the home permanently. Please bring this property into compliance with the Carmel/Clay Zoning Ordinance by March 31, 2008. Failure to resolve the violation(s) by the specified deadline will result in further enforcement action by the City of Carmel.
