Additionally, it has been verified as of today by Kevin Brennen that the City of Carmel has granted Joey a permit for construction of his proposed very large garage. Gray Road, Carmel, Indiana Dear Property Owner: The Hamilton County Health Department was called to investigate a complaint of substandard living conditions at the home at 11739 N. Gray Road, Carmel, Indiana. Environmental Health Specialist, Amanda Beaver, investigated the complaint on December 13, 2007. At the time of inspection, the furnace was not operating at the capacity to maintain the minimum required temperature in the home and therefore numerous space heaters were being used by the tenant. An adequate supply of hot water was not available from the plumbing fixtures in the home and evidence of previous sewage backups was observed on the basement floor near a drain. The Hamilton County Board of Health Rule Concerning Minimum Housing Standards and Dwellings Unfit for Human Habitation, Section 4(c) states, "Every dwelling unit shall be able to maintain a temperature of at least 65°F during ordinary winter conditions. Such heating equipment must be properly installed and maintained in good and safe working condition." Section 4(d) states, "Every dwelling unit shall have heated and unheated running water under pressure." IAC 16-41-20-1 states, "A dwelling is unfit for human habitation when the dwelling is dangerous or detrimental to life or health because of any of the following: 1) Want of repair. 2) Defects in the drainage, plumbing, lighting, ventilation, or construction. 3) Infection with contagious disease. 4) The existence on the premises of an unsanitary condition that is likely to cause sickness among the occupants of the dwelling." Order to Comply The following conditions must be resolved within fifteen (15) days from the date above: I) The furnace must be repaired to ensure a temperature of at least 65°F in the home. 2) The hot water issues must be resolved so that enough hot water is provided to meet the needs of the tenants. 3) The plumbing and drains must be repaired to eliminate the occurrence of sewage backups into the home and the floor of the basement must be cleaned and returned to a sanitary condition. The following are the sections of code in violation: (1) §6-222 (c) 1 General. The exterior of a structure shall be maintained in good repair, structurally sound and sanitary so as not to pose a threat to the public health, safety or welfare. (2) §6-222 (c) 5 Exterior walls. All exterior walls shall be free from holes, breaks, and loose or rotting materials; and maintained weatherproof and properly surface -coated where required to prevent deterioration. (3) §6-222 (g) 3 Interior Surfaces. Floors, walls (including windows and doors), ceilings and other interior surfaces shall be maintained in good, clean and sanitary condition. Peeling paint, cracked or loose plaster, decayed wood and other defective surface conditions, including mold spores, shall be eliminated. (4) §6-222 (g) 6 Free from Dampness. In every building and all portions of the building including, but not limited to, basements and crawl spaces shall be maintained to prevent conditions conducive to mold formation, decay or deterioration of the structure. The eastern exterior wall (window wall) of the 2"d floor bedroom is extremely weak and structurally unsound. This wall does support part of the roof and if it failed a portion of the roof structure would collapse. Additionally, there is water intrusion into the electrical panel box in the basement causing the breakers to trip. No water can be allowed to penetrate this electrical box and all precautions must be taken to ensure that both of these issues are corrected immediately. Please make the required corrections and/or repairs to the structure by January 31, 2008. Failure to comply will result in further enforcement action.
