9h. Opus North Building 3
The applicant seeks the following development standards variance approval:
Docket No. 08080015 V Section 23B.08.03 Reduction of required building height
The site is located at 12711 North Meridian Street and is zoned B2/0ffice/Commercial within the US 31
Overlay.

General Info: The petitioner is requesting to build a one-story building in the US 31
Overlay, which requires a minimum building height of 3 stories and 38 feel.
Analysis: The proposed building is part of a three-building office park, which would
house one tenant. Building 3 would serve as the mail processing center t{)r the site, and
would be located to the south of a five-story office building and a three-story office
building. The overall design and materials used would match those in the taller
buildings, providing an overall campus effect.
While one-story buildings are not permitted in the US 31 Corridor, there are a few
existing one-story buildings. The subject site overall is proposed to be heavily
landscaped, with a large dminage swale and other natural features facing US 31, which
will help screen the building. As the site will be heavily landscaped, and as the
proposed building is part of an office campus and will match the other proposed
buildings, the impact on the intent of the Overlay to create an office corridor would not
be negative.
Findings of Fact: Reduced height
1. The approval of this variance will not be injurious to the public health,
safety, morals, and general welfare of the community because: Building Three would match the other
two buildings and would also meet the design intent orthe Overlay, as well as being heavily screened.
2. The use and value of the area adjacent to the property included in the variance will not he affected in
a substantially adverse manner because: Building Three would match the other two buildings and would
also meet the design intent of the Overlay, as well as being heavily screened.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property because: Building Three is designed for a specific purpose, which
could be negatively impacted if additional height/stories were required.
Recommendation:
The Depl. of Community Services recommends positive consideration of Docket No. 08080015 V after all
concerns have been addressed.
