FINDINGS OF FACT - USE VARIANCE
1. The grant of this variance will not be contrary to the public interest, due to the existence of special condition(s) such
that enforcement of the zoning ordinance will result in unnecessary hardship because:
Reducing tranSDortation times for heart patients will improve survivabilitv rates. The B-6 zoning district
U.S. 31 overlay zone, permits hospitals which commonly utilize helipads.
2. The grant of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
The grant will be beneficial to public health safety and general welfare of the community because the proximity of the
helipad to the hospital tends to decrease patient mortality by decreasing transportation time.
3. The use or value of the area adjacent to,Jhe subject property will not be substantially affected in any adverse
manner because:
The adjacent property is the property benefitting from the helipad. The helipad is being located as far away from the
residential areas (west of the site) as feasible in order to minimize aircraft noise.
4. The need for the variance arises from a natural condition peculiar to the subject property because:
The B-6 zoning ordinance, which permits hospitals, does not include helipads, which are commonly
associated with hospitals.
5. The granting of this variance does not substantially interfere with the Carmel/Clay Comprehensive Plan because:
The Comprehensive Plan does not contem plate, prohibit or otherwise directly address helipads in the
B-6 US. 31 Overlay Zone.
DECISION
IT IS THEREFORE the decision of the CarmelfClay Board of Zoning Appeals that Use Variance Docket No.
is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof
