RESOLUTION CC-10-06-08-02
(AS AMENDED)
WHEREAS, the Department of Local Government Finance of the State of Indiana shall set for
the City of Carmel, Indiana ("City"), the total City tax rate for taxes payable in the year 2009; and
WHEREAS, recent legislation will render tax rates incomparable between 2009 and 2008 due to
significant changes in the way assessed value is calculated; and
WHEREAS, the Common Council desires to adjust the property tax levy to the same effect as
would normally be obtained by keeping the tax rate level; and
WHEREAS, the Common Council finds that the trend of increase in certified assessed value has
been four and four-tenths percent (4.4%) per year in recent years; accordingly, an increase of four and
four-tenths percent (4.4%) in the.levy will tend to have the same effect as would normally be obtained by
keeping the tax rate level; and
WHEREAS,,the Common Council desires to adjust the Cumulative Capital Development Fund
property tax levy as needed to implement the Common Council's tax policy; and
WHEREAS, the Common Council desires to levy for the Motor Vehicle Highway Fund only the
amount needed to fund appropriations, leaving no operating. balance in that fund; and
WHEREAS, the Common Council desires to reserve, as much as possible, its future authority to
levy taxes for general purposes.
NOW, THEREFORE, BE IT RESOLVED "by the Common Council of the City of Carmel,
Hamilton County, Indiana:
Section 1. The foregoing Recitals are incorporated herein by this reference.
Section 2. The. Department of Local Government Finance is respectfully requested to set the total
year 2009 City tax levy, for all City funds, at four and four-tenths percent (4.4%) above the total 2008
City tax levy.
Section 3. The Department of Local Government Finance is respectfully requested to set the 2009
property tax levy of the Motor Vehicle Highway Fetid at a level no greater than the amount needed to
fund appropriations, with no operating balance.
Section 4. The Department of Local Government Finance is respectfully requested to reduce, as
necessary, first the 2009 Cumulative Capital Development Fund levy and then the 2009 General Fund
property tax levy to a level which will result in the total City tax levy stated in Section 2.
