Hi Scott: it has been brought to my attention that the Legacy PUD (Z-501-07) does not require DP/ADLS review/approval
far single family developments, please see the excerpts below:
Section 19.1.C.' No DPI ADLS approva/'by the Commission shall be required with respect to Detached Dwellings and their associated
Accessory Dwellings AccessOIY Structures, landscaoing,)ighting, and signage ....
And
Section 13. The landscaping in the Legacy District shall be designed to compliment the architecture of the Dwellings and Commercial
Buildings Street trees streetscape plantings and buffer areas shall be used to bring natural elements to the design pattern in
consultation with the City's Urban Forester.
And
Section 13.4.8 states: "Within the Neighborhood Residential UseBlock building base landscaping adjacent to the front elevation of
each Detached Dwelling shafl include a minimum of five 5 shrubs and or ornamental grasses Additionally one shade tree and one
ornamental tree shall be planted for every unit."
However, I do think your input on the landscape plan plant species is helpful to the petitioner! Nick Churchill will be preparing en email
to explain along similar lines.

I received construction plans for The Legacy Domain on Aug 22, 2008, that did not have any landscape plans in them.
This single sheet that you have provided my toda,y with each small section cut up and not imposed on a site plan does not
allow me cross check for conflicts for utilities or easements or anything else. Landscape plans should be submitted with
the other plans in the construction phase packet
1. Please submit a landscape plan over a site plan with the utility and easement layers on as well.
2. Species: Red maples shall not'be used as street trees, they are thin barked, shallow rooted, and easily injured,
plus they are not drought tolerant. Please choose another from Carmel's list of large or medium growing shade
trees. Winter King hawthorns have large thorns and should not be planted where they can grow into the right-of-
way to conflict with pedestrians or vehicles. There are 7 Norway maple Crimson King on the plan, and while a fine
specimen tree, they suffer from an invasive fungus that makes them not long lived. I would suggest another
species with red fall color, or a more formal shape to attain what you are looking for here.
Species Diversity: You shall have at least 7 species of trees on the plan to meet the species diversity guidelines.
You have 5 species now, I would suggest you add another shade tree species and another ornamental species.
Please contact me if you have any further questions. I will have further review comments when I receive the revised
plans.

under development and the builder does not feel comfortable putting them into the public record. However, I will include
them in our presentation to the Plan Commission and commit that we will meet all requirements of the Legacy PUD
Ordinance as it relates to character and architectural requirements.

dated July 22, 2008. Those comments were addressed as tollows:
DOCS REVIEW COMMENTS
1. PDF's of the application, plat and associated exhibits will be provided as
requested.
2. Excerpts ofthePUD ordinance Z-501-07 will be provided as requested.
3. Tbe proposed plan will comply with Exhibit 8, footnote I.
4. Conceptual building elevations are currently in the design process.

Dear Mr. Kritz:
We have reviewed the primary plat submitted to the Hamilton County Surveyor's Office on July
21,2008, for this project and have the following comments:
1. The proposed project falls in the incorporated area & MS4 jurisdiction ofthe City of
CarmeL
2. The proposed project DOES fall in a Cam1el Wellhead Protection Zone.
3. The proposed project is located in the Tunis Gerard Regulated Drain Watershed.
4. The proposed primary plat does have the Jolm Owens Arm, JohI). Owens Arm 2, and
Arm 5 of the Tunis Gerard Drain within the boundary of this area. These arms to the
drain have 75' per half statutory regulated drain easements. This information is not
shown of the primary plat
5. The primary plat does not show the floodplain per the February 19, 2003 FIRM Panel
18057C0235F. The panel shows a Zone AE with a BFE Of 752, which encompasses
part of this primary plat area per the provided tapa infonnation on sheet 2.
6. Although the Hamilton County Surveyor's Office has reviewed this primary plat and
issued a comment letter, this office will not be limited by the primary plat in regards
to the pond sizes or location, drainage easement widths, storm sewer locations, lot
layout, landscape layout, or any other drainage related issues. Insufficient
information is presented to conduct a complete drainage review and changes may be
required during the construction planning stage.
