This email is in response to your request for a Consent to Encroach Agreement regarding placement of your
patio within a Sanitary Sewer Easement. Aaron Hoover, Utilities Department inspector, initially visited your
property 1 located at 1604 Quail Glen Court, and determined that a future open-ditch excavation of the sanitary
sewer in your rear yard is unlikely due to the depth of the sewer main and the proximity of your existing home
to the sanitary sewer. The Utilities Department does still need access to the sanitary manholes in your yard,
and any private improvements that are placed within easements are subject to removal in the event that the
City or any other easement holder (cable company, phone company, etc.) would need to exercise their rights
to the easement.
Upon the Engineering Department's inspection of your property and review of your proposed patio extension, it
appears that although the proposed improvements would be installed to the edge of the existing 15-foot
Drainage and Utility Easement, the improvements would not encroach into this easement. It does not appear
that the proposed improvements will have a negative drainage impact on the adjacent properties or on the
conveyance of stormwater runoff across your property; therefore, if the requested development standard
variance is obtained from the Department of Community Services, this Department will provide a favorable
recommendation to the Board of Public Works and Safety for approval of the Consent-to-Encroach Agreement
for the encroachment into the Sanitary Sewer Easement.

The Cliffords, 1604 Quail Glen Court, Carmel IN, Lot 53 of the Fairgreen Trace
Subdivision, requested approval. of the Architectural Committee of the
Fairgreen Trace Homeowner's Association Board of Directors, to install a
patio extension behind their residence. The rear of their lot has a steep
slope and in order to enjoy their property it required the installation of a
retaining wall. The committee determined the patio would not extend into
the common grounds. The Cliffords sought an opinion from the Carmel City
Engineer. He determined that the patio extension would not encroach into
the drainage easement nor would it have a negative drainage impact on
the adjacent properties or on the conveyance of storm-water runoff.
The proposed design of the patio extension is esthetically pleasing and in no
way unsightly. The new addition will increase the value of the property and
enhance the Cliffords · enjoyment of their property.
The Fairgreen Trace Homeowners' Association Board of directors is in favor
of this request.

To the Carmel Variance Committee;
This letter pertains to the improvements the Clifford family at 1604 Quail Glen
Court in the Fairgreen Trace Subdivision has planned to make to their back yard.
Their architectural form was submitted with a drawing and was given approval by
all of the members of the Architectural Committee prior to the start of any work.
The Cllffords gave additional information to answer any questions about clarity of
their plans to the satisfaction of the committee members.
In the past the Cliffords have submitted approval forms and have made quality
improvements to their property, and the committee feels that the current project
will not only add to the value of the Clifford home but also help increase the value
of our neighborhood by encouraging others to do similar projects to their homes
and property.
The following neighbors are currently serving on the Architectural Committee and
have signed the form giving their approval: James Buckhorn, Craig Sherman,
and Nancy Williams, as well as the chairperson of the committee.

I am the next door neighbor of Mary Ellen and Tim Clifford. I am writing this letter because I will not be in Carmel on
October 27th a"nd therefore unable to appear in person before the Board of Zoning Appeals. If I were able to be present at
the meeting I would voice my strong support for the work Mr. and Mrs. Clifford want to do in their backyard. The addition
of the back patio will improve their property and thereby also improve my property value. As my property is the only
