Docket No. 08060009 Z: 116th & Guilford Rezone The applicant seeks to approval to rezone approximately 9.S acres from the l-l/Industrial zaning classification to. PUDlPlanned Unit Develapment. The site is lacatcd at the nartheast corner of ] 16th St & Guilford Rd. Filed by the Carmel Department af Co.mmunity Services, 0.11 behalf af the Carmel Plan Cammissian. There are no. develapment plans associated with this petitio.n, nar are any projects propased at this timc. However, due to recent and proposed development in the surrounding area, a change in zoning, fram its current I-l/lndustrial to. the PUD/Planned Unit Develapment zoning classification, (coupled with the Park Place PUD ordinance amendment, Dacket Number 08060010 OA) is propased to. assure the Carmel Plan Cammissian and Carmel City Cauncil havc the greatest apportunity to. review plans for the property should redevelopment ever be propased at this corner. The propased rezoning will no.t affect Duke Energy's ability to maintain aperatians in thc current facility, nor will it prohibit similar uses (such as a public service facility or offices) allowed in the l-l/Industrial District from occupying the current facility. If the current use disconti nues for a period longer than ane (I) year, the premises shall thereafter canfarm to. the provisions af the PUD District. At the July 15 cammission meeting, it was suggested that a sunset clause be added. Also, the issue of property rights and landowner rights arose. The attorncy for thc current property owner pravided a list af land uses they wauld be willing to exelude, as a legal document. 51. Docket No. 08060010 OA: Park Place PUD Ordinance Amendment The applicant seeks approval to amend Ordinance 2-500-06: Park Place Planned Unil Development in arclerto inclucle 2 parcels at the northeast corner of 116'1> 5t & Guilford Rd. and to amend/add text to regulate the newly added parcels to this development. The subject parcels are zoned PUD & I-I. Fi led by the Depmtment af Communi ty Services, on behalf of the Carmel Plan Commission. The Park Place Ordinance was adopted in 2006, which set the framework an assisted and independent living center. This ordinance amendment will bring the 2 parcels just sauth of the site under the Park Place PUD's jurisdiction. Parcell, the original piece of land regulated by the Park Placc PUD, will not be affected by this ardinance amendment. This ordinance amendment, partnered with the rezone (docket no.. 08060009 Z) of the 2 parcels from I-l/lndustrial to PUDIPlanned unit development will provide assurance that the Carmel Plan Commissian and Carmel City Cauncil have the greatest oppal1unity to. review plans far the property should redevelopment be proposed in the future at the northeast corner of 116'h Street and Guilford Road. A draft of the Park Place PUD ordinalll:c amendment, which adds parcels 2 and 3 to the language, as well as additional regulations and limits on permitted uses for those two parcels, was pro.vided to the Commission members ancl is an file All proposed changes are highlighted in the info packet On August 5, the Subdivision Committee discussed the permitted uses list and came up with a list af limited permitted uses for parcel 3. The attached PUD ordinalll'e text (Version 2) renects these changes. The cammittee voted 4-1, an a favorable recommendatian to the Canunissioll. TIle Department of Community Services recommends the Commission amends the permitted uses list to remove the General Retail and General Sel'Vice uses and then sends these items to the City Council with a favorable ["ecOlmnendation.
