From a conversation I had with Paul Reis I was under the impression that this matter was going to be tabled, but now understand that it is not continued and is on the agenda for tomorrow evening. My client's position is ralhersimple. Duke Energy objects to any attempt by Carmel to rezone the property at 116th and Guilford. For many years it has been zoned 1-1, which, as you know, inclUdes many uses including retail operations. The Duke property has had the right to use the property for retail purposes long before other property contiguous 10 it petitioned the city to obtain the right to use their property for retail operations. The City now trying to eliminate that use form Duke's property because it does not want to "dilute" the present amount of retail operations is unfair and critically devalues the property. Consequently, Duke has no choice, butto object to the wholesale rezoning of the property and will contest that attempt at every opportunity. However, Duke, as a member of the community, is willing to amend the current 1-1 permitted uses by agreeing to limit some of the more incongruent uses found in that classification. You have already received a copy of the uses Duke would agree to eliminate. We will be prepared to distribute that list tomorrow. If you have any questions please contact me.
