ORDINANCE D-1914-08
AN ORDINANCE OF THE COMM
WHEREAS, pursuant to Carmel City-Cod'e Chapter 8, Article 3, Section,8-15, and Indiana Code
§9-21-5-11, the City of Carmel, Indiana, has the authority to,establish motor vehiclespeed limits up to ten
(10) miles per hour lower than the miaximum 'established. speed limits within and in the, vicinity of
worksites•, and
WHEREAS, lower speed liniits1n the vicinity of-and within worksites make them safer for both
vehicles and construction workers; and
WHEREAS, the Indiana Design, Manual and Manual on Uniform Traffic Control Devices
establish the.paraiheters for signs'designating worksite speed limits; and
WHEREAS, the City of Cannel£ngineeripg_Departmenthas'the resources and skills needed to
properly assess.the,appropriate speed limits Ior worksites; and
WHEREAS, the ss tcty of the,tcavelling public requires the enforcement of worksite speed limits
even if workers are not present:within or-in the immediate.vicinity of the work"site.
NOW, THEREFORE, BE IT ORDAINED by 'the Common Council of the. City of Carmel,
Indiana, as follows:
Section.l. The foregoing Recitals are fully incorporated, herein, by this'.reference.
Section 2, Chapter 8, Article 3; of'the, Carmel City Code should be and the same is hereby
amended to add,a;new Section 26,.which shall read. as follows:
8-,26. Worksite Speed Limit Designation
(a) For'the duration of the following City road construction projects the motor vehicle speed limit is
designated as:
1), Keystone, Avenue and 1.06" Street-Project- 40"mph on Keystone Avenue. within and in the vicinity
of the, Project worksite;
2) fteystore Avenue and 126'". Street Project - 40 mph on Keystone Avenue within and in the vicinity
of the, Project _work_s.it&;,
) Reserved.
(b) The Carmel Street WpMmentshall post,appropriate signs and markings clearly indicathg'thereon the
above-designated worksite speed limits.

1) The judgment for a person's first"violation of this, Section, shall, be at least Three Hundred Dollars
{$300A0);
2) The judgment for a person's second'viclation of this Section within the.same three (3) year period
shall be at least Fite Hundred Dollars ($500.100);
3) The Judgment for a person's third and+for, each. subsequent violatiomof:this Section within the
same three (3) year period shall be atieast;One Thousand Dollars ($1,000:00);"
Section 3. All prior City ordinances or parts. thereof; that are inconsistent with any provision of
this Ordinance are hereby repealed asofthe effective date of this Ordinance.
Section 4. if=airy portion of this Ordinance isfoi any reason declared to be unconstitutional or
invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as
enforcement of same can be given the same effect.
Section 5. 'This Ordinance compliments and.does not limit the abif ty of.lacv enforcement officers
to, charge any person-with the violatiori b£any other-law or ordinance.
Section 6. This Ordinance shail'be in full, farce and.effect,from and after its passage,and signing
by the Mayor and such publication as'is required by law.
