The applicant seeks to rezone approximately 9.5 acres from I-1/Industrial to the
R-I/Residence District Zoning Classification.
The site is located at 1441 S. Guilford.
Filed by the Carmel Dept. of Community Services.
There are no development plans associated with this petition, noris any project proposed.
However, due to recent and proposed development in the smrounding area, a change in
zoning, from its current I-l/lnduStrial to R-1/Residence, is being proposed to assure the
Carmel Plan Commission and Carmel City Council have the greatest opportunity to
review plans for the property should redevelopment he proposed at this comer. Under an
I-lIlndustrial Zoning Classification, a wide range of industrial uses would be pennitted
by right, including warehousing, storage and light manufacturing; currently residential is
not a permitted use. Given the manner in which the area has recently evolved, an R-
l/Residence zoning would be better fit to its surroundings.
The proposed rezoning would not affect Duke Energy's ability to maintain operations in
the current facilIty, nor would it prohibit other nOll-residential uses allowed in the I-
I/Industrial District from occupying the cun'cnt facility. If the non-residential use
discontinues or the property is vacant for a period longer than one (1) year, the premises
shall thereafter confoml to the provisions of the R-lIResidence District. Though this
proposal would not prohibit the propeliy owner from requesting. rezoning to a Business
District or Planned Unit Development in the future, we have a unique opportunity to take
a proactive approach to this site.
Public Notice and publication met the ten-day State public notice requirements, but not
the twenty-five day requirement of the Plan Commission Rules of Procedure. In order
for the Plan Commission to hold the Public Hearing, a suspension of the Rules will need
to occur.
The Department requests this item be sent to the February 6th Subdivision
Committee Meeting for further revi.ew and discussion.
