2. Docket No. 07010008 Z: 116th & Guilford Rezone
The applicant seeks to rezone approximately 9.5 acres from I -lIIndustrial to R-lIResidcnce. The
site is located at 1441 S. Guilford Rd. Filed by the Carmel Dept. of'Community Services on
behalf of the Carmel Plan Commission.
There are no development plans associated with thi~ petition, nor is any project proposed.
However, due to recent and proposed development in the surrounding area, a change in zoning,
from its current l-l/Industrial to PUD, is being proposed to assure the Cannel Plan Commission
and Carmel City Council have the greatest opportunity to review plans for the property should
redevelopmentbe proposed at this corner. A new rezone and PUD ordinance amendment request
will be presented at the July 15 Plan Commission meeting. Attached is a draft of this pun
ordinance amendment to jump start discussions about the new rezone request. Most likely,

The applicant seeks to rezone approximately 9.5 acres from 1-lIlndustrial to R-1/Residence. The
site is located at the northeast comer of 116th & Guilford, at 1441 S. Guilford Rd. Filed by the
Carmel Dept. of Community Services
This item was heard at the February 20, 2007 Plan Commission meeting. At that meeting the land
owner's attorney spoke in opposition stating concerns for his client's continued and future use of th
property as permitted by the Industrial Zoning designation. Since then, the attorney for the property
Owners had several discussions with staff. Staff is currently waiting on a return phone call from the
property owners' attorney.
There are no development plans associated with this petition, nor are any proposed. However, due to
recent and proposed development in the surrounding area, a change in zoning, from its current I-
I/Industrial to R-I/Residence, is being proposed to assure the Carmel Plan Commission and Carmel City
Council have the greatest opportunity to review plans for the property, should proposed redevelopment
ever occur at this corner. Under an I-lIIndustrial Zoning Classification, a wide range of industrial uses
would be permitted by right, including warehousing, storage and light manufacturing; currently
residential is not a permitted use. Given the manner in which the area has recently evolved, an R-
llResidence zoning would be better fit to its surroundings.
The proposed rezoning would not affect Duke Energy's ability to maintain operations in the current
facility, nor would it prohibit other non-residential uses allowed in the 1-I/Industrial District from
occupying the current facility. If the non-residential use discontinues or the property is vacant for a
period longer than one (1) year, the premises shall thereafter conform to the provisions of the R-
llResidence District. Though this proposal would not prohibit the property owner from requesting
rezoning to a Business District or Planned Unit Development in the future, there is a unique opportunity
to take a proactive approach to this site.

The Department recommends this item be forwarded to the full Plan Commission meeting
on April 15 with a positive recommendation after all comments/concerns are fully
addressed.

This letter is to inform you, as O\Nner of record, that the Cannel Plan Commission will hold
a public hearing at its regularly scheduled meeting on Tuedsay, January 16, 2007, regarding
property at 1441 South Guilford Road, located at the northeast corner of 116th Street and
Guilford Road. The properties are also identified in the enclosed map and by tax parcel ID
numbers 17-09~36-00-00-054.000 and 17-09-36-00-00-054.001. The purpose of the
hearing is to consider a proposal to change the zoning classification of the property from
the I-l/Industrial District to the R-l/Residence District Classification.
Due to recent and proposed development in the surrounding area, a change in zoning to the
R-IlResidence District, is being proposed to assure the Cannel Plan Commission and
Cannel City Council have the greatest opportunity to review plans for the property should
you or a future property owner propose future redevelopment. The proposed rezoning will
not affect Duke Energy's ability to maintain operations in the current facility, nor will it
prohibit other non-residential uses allowed in the 1-lIlndustrial District from occupying the
current facility, provided that the facility is not vacant for a period of one (1) year. If a non-
residential use discontinues or the property is vacant for a period longer than one (1) year,

Notice is hereby given that the Carmel Plan Commission will hold a public hearing upon a Petition To
Rezone property pursuant to the application and plans filed with the Department of Community Services
as follows:
Rezone of property at the northeast corner of I 16t11 Street and Guilford Road, comprising 2 parcels, from
the 1-1Ilndustrial District Classification to the R-IlResidence District Classification. The properties are
also identified by tax parcel ill numbers] 7-09-36-00-00-054.000 and] 7-09-36-00-00-054.001.
Designated as Docket No. 07010008 Z, the hearing \\<ill be held on Tuesday, January 16,2007, at 6:00
PM in the Council Chambers, Carmel City Hall, One Civic Square, Carmel, IN 46032.
The file for this proposal (Docket No. 070] 0008 Z) is on file at the Carmel Department of Community
Services, One Civic Square, Cannel, Indiana 46032, and may be viewed Monday through Friday bet\veen
the hours of 8:00 AM and 5:00 PM.
Any \vritten comments or objections to the proposal should be filed with the Secretary of the Plan
Commission on or before the date of the Public Hearing. All written conunents and objections will be
presented to the Conunission. Any oral comments concerning the proposal will be heard by the
Commission at the hearing according to its Rules of Procedure. In addition, the hearing may be continued
from time to time by the Commission as it may find necessary.
