RESOLUTION NO. ZOO- P RF$OLUTIOiy OF, THE, CITY OF CARMEL, HA ILTO-M COUNTY, INDIANA REDEVELOPMENT COMMISSION CONFIR34 TNG A•RhSOLUTION OF THE,COMMSSION 'DECLARING THE LEGACY PROJECT ECOl ONitC DEVELOPMENT AREA TO BE AN, ECONOMIC DEVELOPMENT-AREA, APPROVING THE ECONOMIC DEVELOPMENT PLAN FOR SAID AREA, AND ESTABLISHI3-4G AN ALLOCATION,AREA-trOR.PURPOSE.S OF TAX INCREMENT FINANCING - WHEREAS, on° May 21, 2008, the City of Carmel, Hamilton County; Indiana; Redevelopment Commission (the "Commission") approved, and adopted a resolution (tlle "Declaratory Resolution"); in which it-,(a) found and determined That a certain area in the City'of Cannel, Indiana (the "City"), designated," the Legacy Project-Econornio Development Area, is ail economic development, area. (the ''Area") within the meaning of. Indiana Code 36-7-14, as amended (the°"Act"), (ti) designated the entire Area as an "allocation area" raider Section*B of the Aci (the"'Allocation Area"), and (c)appr©ved.an.&conornic.Devcilopment'Plan for the.Ariea (the "Plan");-and WHEREAS, pursuant to Section 16(a) of:tl e Act, the Carmel Clay Plan.Cornmission (tbe "Plan Commission") has beretofore:adopted a Resolution constituting its written order approuiog the Plan and the,designation of the Area (die "Plan Commission Order"); and WHEREAS, pursuant to Section 16(b) of'the Act; the Common Council of the City of Catmeli Indiana, has heretofore adopted its' -Resolution' which approved the Plan Commission Order; and WHEREAS; pursuant to Section 17 of the Act; the Commission (i) caused to be published'a notice of public liearng concerning. the. Declaratory Resolution and the Area on the 6th day of September; 2008, (ii) filed a copy of said'.notice with departments,bodies or officers of the City baving to do with planning; variances from zoning ordinances, land use or the issuance of building permits, and, (iii) filed a copy-of said notice and a'statetnent disclosing the impact of the Allocation Afea' Mth each taxing„unit drat is° wholly or partly.located within the Allocation Area; and WHEREAS;,ai the,hearing bald by the,Commissiou on the 17th day d .September, 2008;, 'at 6:30'p.m. {local time),'in Council Chambers of Carmel City Hall, One Civic Square; Carmi 1, Indiana, the Commission heard all persons' interested in the,proceedings=and considered written remonstranc'es.and objections` sled, if any, and such other evidence presented; and WHEREAS, the. Commission now desires to take final action ;determining the public utility and benefiVof the proposed acquisition; redevelopment and economic development of the Area mid confirming the Declaratory Resolution, in.accoidance with Se6tion't7(d) of Ile Act; 19OW, THEREFORE, BE IT RESOLVED by the>Cily of Carmel; Hamilton County, Indiana, Redevelopment Commission as follows: 1. Afier considering the evidence presented at the hearing on the 17th. day of September, 2008, the Commission hereby confinns flte 'findings and determinations of the designation df t1w Area and all other findings and determinations;'designations' mid approving and adopting;actions•contained in the Dec] aratory Resolution. 2. The Coins iissioir hereby finds and determines that it will be ofpublic utility and benefit to proceed with tbe,-Plan in the form approved by 'the Commission. in the Decla,'story Resolution. 3. The: Declaratory Resolution is ber6by.confirmcd. 4. This Resolution constitutes final action, pursuant to Indiana Coder36-7-14-1'7(d), by the Commission determining the public utility and benefit of the proposed project mid confiTaiing the Declaratory Resolution pertaining to theArea. 5. The, Secretary of'the Commi'ssion.is directed to "record the final "action taken by the Comm ission.,pursuantto the requirements ofandiana Code 36-7-14-17(d), * * * * * -2- ADOPTED AND APPROVED at a meeting of the City of Carmel, Hamilton County, Indiana, Redevelopment Commission held on the 15th day of October, 2008.
