public hearing dale. The certified "Proof of Publication" affidavit for the nelNSpaper must be available for inspection the
night of the hearing.
LEGAL NOTICE to all adjoining and abutting property owners is also MANDATORY, two methods of notice are
recommended:
1) CERTIFIED MAIL - RETURN RECEIPT REQUESTED sent to adjoining property owners. (The white receipt
should be stamped by the Post Office at least twenty-five (25) days prior to the public hearing date.)
2) HAND DELIVERED to adjoining and abutting property owners (A receipt signed by the adjoining and abutting
property owner acknowledging the twenty~five (25) day notice should be kept for verification that the notice was
completed)
REALIZE THE BURDEN OF PROOF FOR ALL NOTICES IS THE RESPONSIBILITY OF THE APPLICANT. AGAIN, THIS

Proposed Addition/Existing Fire Hydrant
Confirming our telephone conversation of July 11, I met with Steve Cook of CU and one of his
associates at the site July 10 to discuss moving the existing fire hydrant away from our
proposed building addition.
After reviewing our options and the required clearances we decided to leave the hydrant where
it is and build the west side of our building addition as far west as the required clearances (for
both the water main and fire hydrant would allow.
The attached drawing shows the revised building plan along with the clearances that both you
the Water Department requested. I would appreciate it if you would review the drawing and if
the clearances shown are acceptable to you respond back to me with a letter indicating your
approval.
Thank you again for your assistance in helping us to resolve this matter.

1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
The proposed addition only expands on the Museum use of the present property.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The propused addition is only 850 S.F. in area, and has been designed' to
match and compliment the style of the neighboring commerical buildings.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
The Museum needs the proposed building addition in order to: provide
additional meeting... exhibition, and work space. To provide a "show window"
to display items from their collection. To provide a protected stair
entrance from street level.
DECISION
IT is THEREFORE the decision of the CarmeVClay Board of Zoning Appeals that Development Standards Variance
Docket Nre. 08LO0019V, 20V. and 21V is,granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof.
