Brady,
Thank you for your response. The revised Sheet 2 looks good, except for the northeast comer of lot 6 is still missing a
monument. Once that monument is added and the recorded covenants information is added, the mylars will be ready to
be signed. I will make the original mylars available at our office if you would like to have them picked up so you can
add the covenant information. .

Here are responses to your comments:
1. On Sheet I, please reference the instrument number for the recorded covenants and restrictions.
I need to get the recording information for the covenants and restrictions from the client. Can you send the original mylar back so I
can write these on the first sheet? Our client is Tennessee so I would like to make the modification without reprinting and getting
new signatures from them.
2. If possible, please separate the gas line easement from the landscape setback, per the landscape plan, in an effort to
protect any landscaping there form being tom up at a later date should there need to be work done on the gas line.
The gas line easement existed on this parcel prior to any development. Therefore, it supersedes the plat. The easement was
shown on the overall section 1 plat and the 2 previous block plats as it is on this one.
3. Please show and label any monuments and markers on the plat. Are there (as I believe there should be)
monuments at the comers of the lots per Subdivision Control Ordinance Section 8.02?
I have added monuments to the attached copy of the plat. Since the area is under construction, we typically set the monuments
after they finish grade the lot so they won't get knocked out with contractors running across them.
4. Also, it looks like the building unit lines are offset a little bit from the lot lines. I didn't know if they were
supposed to match up or if they were supposed to be offset a little. Please verity if they are correct as shown or need to
match up with the lot lines.
The building unit lines you see on the plat are exterior wall lines. The lot lines are divided to run down the center of the common
wall line between units. They are shown correctly on the plat.
I will work on getting the recording information for the covenants. Please let me know if the attached sheet 2 is okay.

Do you know if they have paid their commitments? I know that there has not been a concerted effort to rectify
the sight distance issue on Smokey Row that they are obligated to do. We may want to consider these items

Please add to item No.1 of the unresolved issues that the commitment for upgrades to Smokey
Row Road shall be as provided by the petitioner via email to Engineering on April 21J 2006J
less the improvements to the existing bridge. The commitment for the roadway improvements
prescribed by the Thoroughfare Plan would be equal to $82J669 per the cost estimate provided
by the petitioner. The Department would also expect that the existing sight distance issue
associated with the location of the entrance to the development be constructed by the
petitioner and that these costs would be exclusive of the commitment (cannot credit against
the commitment). The Department will work with the petitioner on an acceptable solution to
the sight distance issue at the next stage of approval.
As it relates to Item No.2 of the items requested at the last meetingJ a proper path to the
west should include construction of a pedestrian crossing of little Cool Creek. Construction
of such a bridge would result in a level of commitment/participation from the developer that
is substantially higher than commitments/participation provided by recentJ similar
developments when considering the request for roadway improvements and remedying the existing
sight distance issue. The Department suggests that the petitioner extend the existing culvert
as necessary to facilitate the construction of the path across the frontage. The path may
need to be angled out towards the road as it approaches the slightly widened culvert.
Construction of the path from the proposed entrance to the west property line is included in
the requested commitment above. ThereforeJ construction of the multi-use path across the
frontage as well as extension of the pipe culvert may be credited against the above requested
commitment.
In any approvals by the Plan CommissionJ the Department requests that such approvals be
conditional upon incorporating Items 16J 24J 25J 27 and 34 of a letter dated January 17J 2006
from Engineering to the petitioner into the final construction drawings.
All other previous comments/issues have been satisfactorily addressed.
