Pohl December 4,, 2008 Code Enforcement Inspector RE: Carmel City Code! Violation -Noise Regulations Dear Sirs, We are in receipt of the letter from Mr. Bryan W. Pohl dated November 24, 2008. The letter was provided to inform the church, members that we, were in violation of Carmel City Code 6-158 (a) (2). The letter sent to us indicated that the Carillon Bells "was clearly audible from the attached multifamily dwellings abutting to the north of the subject site, as well as from points to the south, of the subject site". We were instructed by Mr. iPolhl to "either cease this music immediately, or lower the volume of the music so that it is not audible from beyond your property, by December 5, 2008". Mr. Pohl was kind enough to supply us with a 1portion of the City Code that dealsdirectly with what is and is not acceptable by the City of Carmel. We had this beautiful Carillon Bell gift installed just three weeks ago and truly thought we had the sound adjusted to a point that would not be bothersome to any of the neighbors. Thank you for bringing this complairitto our attention. It is and always has been our policy to be the best neighbors that we possibly can be. The Carillon Bells at the church ring twice each dlay; once at noon and once at 6:00 pm. The bells ring the time and then play three minutes of music appropriate for the season. Since the receipt of your letter we have done the following to fall within compliance; we have, lowered the sound by 25%; installed insulated sound proofing material on two sides of the bell tower to help reduce the sound going both north and south. We further purchased a Digital Sound Level Meter to test the sound emanating from our bell tower currently and will continue monitoring the levels on a routine basis. During our measurements we found that the sound level was averaging 63 decibels to the north. The sound to the west was averaging about 60 decibels. The Sound to the, east and to the south, of our property was averaging 60 to 63 decibels per reading. As I am sure you are aware it can be difficult to get the proper reading due to normal automobile traffic noise emanating at about 70 decibels. I personally checked the sound readings on the north and northeast side of our church property and found no reading that averaged more than 65 decibels. I will continue to monitor the sound of the bells and will1make any adjustments that would be necessary to remain in compliance with the Carmel City Code. According to Carmel City Code §6-158 (a)(2): (a) No :Person shall play, use or operate any machine or device for the producing or reproducing of sound, including, but not limited to, loudspeakers, radios, CD, players, television sets, musical instruments, phonographs and cassette players, nor any other machine or tool that produces sound, nor shall any person operate any motor vehicle that contains a modified or defective exhaust system, if such machine, tool or vehicle is located in or on any of the following: (1) Any public property, including any public right-of-way, highway, building, sidewalk, iP ublic space, park or thoroughfare and the sound generated!, therefrom is (A) audible 40 feet or more from its source, or (B) is at a level of 90 decibels or more when measured on a dB(A) scale from a distance of not less than six feet from its source; or (2) Any private property and the sound' generated therefrom is (A) audible 40 feet or more outside of said private property line, or i(B) is at a level of 90 decibels or more when measured on a dB(A) scale from a distance of not less than six feet from said private property line. Site investigation was conducted on the days of November 21" and November. 24 1h 2008. This investigation revealed that the bell music emanating from, your property was clearly audible from the attached multifamily dwellings abutting to the north of the subject site, as well as from points to the, south of the subject site. Because of the intensity and duration of the bell music, the sounds from your property are: deemed to exceed customary and ancillary noises, that would be expected from such a use as is conducted on your property. Please either cease this music immediately,, or lower the volume of the music so that it is not audible from beyond your property, by December 5, 2008.
