Trabue 8052 Talliho Dr. Indianapolis, Indiana 46256 RE: CITY CODE VIOLATION - FENCE REPAIR / HIGH WEEDS & GRASS Dear Sir / Madam: This letter is being provided to inform you that an inquiry was made to the Department of Community Services regarding a possible City Code Violation at 604 Mohawk CL, in the City of Carmel, a property listed under your ownership. An inspection revealed that the concern appears to be valid and that the property is in violation of the Carmel City Code S 6-222 B: (6) Accessory structures. All accessory structures, including detached garages, fences and walls, shall be maintained structurally sound and repaired as to not be dangerous, unsafe, unsanitary or otherwise unfit for human use; or shall not be an invitation to children and endanger the lives of such children, or which because of its condition has become a fire hazard and shall not be installed or located such that they cause, create or result in or represent the potential to cause, create or result in a Detriment. Also, Indiana State Code S 675 IAC 20-4-27 sets the requirements for enclosures surrounding pools, hot tubs, and spas: (1) Walls or fencing not less than five (5) feet high and completely surrounding the pool and deck area with the exception of self -closing and latching gates and doors, both capable of being locked. As per the Carmel/Clay Zoning Ordinance, Chapter 3, fences are defined as a structure. The current condition of the fence in the rear yard of this property is a public nuisance as per the above quoted City and Indiana Code. Please inspect all fence panels, posts, and connections for structural soundness. Neighbors are propping -up falling sections of fence with cords and other measures to keep those sections from falling onto their property. Please ensure that the fence is in good repair and structurally sound by October 7, 2008, to prevent further enforcement action to include the issuance of daily citations as long as the violation persists.
