Whenever complaint is made to the Mayor that a public nuisance exists or has existed within the City, he shall promptly notify the Building Commissioner, or some other City official whom the Mayor shall designate, who shall forthwith inspect or cause to be inspected the premises and shall make a written report of his findings to the Mayor. Whenever practicable, the inspection officer shall cause photographs to be made of the premises and shall file the same in the office of the City Clerk -Treasurer. (b) Summary abatement. (1) Notice to owner. If the inspection officer shall determine that a public nuisance exists on private property and that there is a great and immediate danger to the public health, safety, peace, morals or decency, the Mayor may direct the Chief of Police, or a deputy sheriff, to serve a notice on the owner, or, if the owner cannot be found, on the occupant or person causing, permitting or maintaining such nuisance and to post a copy of the notice on the premises. Such notice shall direct the owner, occupant or person causing, permitting or maintaining such nuisance to abate or remove such nuisance within 24 hours and shall state that unless such nuisance is so abated, the City will cause the same to be abated and will charge the cost thereof to the owner, occupant or person causing, permitting or maintaining the same, as the case may be. (2) Abatement by City. If the nuisance is not abated within the time provided or if the owner, occupant or person causing the nuisance cannot be found, the Building Commissioner, or some other City official whom the Mayor shall designate, shall cause the abatement or removal of such public nuisance. (c) Abatement by court action. Junk and Junk Cars. § 6-106 Definition of Junk and Junk Cars. (a) The word Junk used in this division shall mean any articles in any form composed of or consisting of any of the following enumerated secondhand, discarded, abandoned or cast-off metals or materials, namely, iron, brass, bronze, copper, tin, zinc, lead or any other metals or compounds thereof, broken glass, rags, clothing, rubber, plastics, and synthetic substances and fabrics, bottles, papers, feathers or any other waste material or any compound or by-product of the foregoing enumerated materials; junk shall also include and mean, wrecked, abandoned or dismantled automobile or parts thereof. -:P (b) For the purpose of this division, a Junk Car shall mean any motor vehicle which does not bear a currently valid license plate, and is not kept in a garage or building. ('91 Code, § 6-106) .* § 6-107 Junk and Junk Cars Declared Nuisances. Because of the danger of health by vermin and insects and because of the danger of the safety of children attracted by junk or junk cars, abandoned and junked motor vehicles are declared to be nuisances except in lawfully operated junk yards. ('91 Code, § 6-107) ,_V § 6-108 Storage Prohibited. It shall be unlawful for any person to store or to allow to remain in the open upon public or private property within the City, any disassembled and/or non -operative and unlicensed, or junked, wrecked or abandoned motor vehicle for a period of five days or more on public property, or a period of 15 days or more on private property unless it is in connection with an automobile sale or repair business. ('91 Code, § 6-108) (Ord. D-518, 7-7-87) § 6-109 through 6-113 Reserved for Future Use. Division V. Abandoned Vehicles. Statutory reference: Abandoned vehicle regulations, see L C., 9-22-1 et seq. § 6-114 Abandoned Vehicles Declared Public Nuisances. (3) If such vehicle is not removed within three days after such notice, the Chief of Police, or his designee shall cause said vehicle to be removed by a junk or salvage yard or wrecker service, the cost and expense of such removal by a junk or salvage yard or by a wrecker service to be paid by the owner of the vehicle. (4) Impounded vehicles shall be released either upon payment by the owner, operator, or authorized representative of same, of the fees charged for towing and storage, or upon order of the Chief of Police or his designee, or upon the order of the Judge of the Carmel City Court. (5) The form of all notices shall be issued pursuant to the provisions of I.C., 9-22-1-11. (b) Private property. (1) Whenever the Chief of Police or his designee shall find such vehicle placed or stored in the open upon private property, within the City, he shall issue an order to the owner of such vehicle, if known, or the person who owns or controls the private property upon which such vehicle is placed or stored according to the procedures set forth in I.C., 9-22-1-11 through 9-22-1-14. (2) Impounded vehicles shall be released either upon payment by the owner, operator, or authorized representative of same, of the fees charged for towing and storage, or upon order of the Chief of Police or his designee, or upon the order of the Judge of the Carmel City Court. ('91 Code, § 6-117) (Ord. D-832, § 6-117, 9-22-92) §.6-118 Enforcement. (a) If such vehicle is not removed within three days after such notice, the Chief of Police, or his designee shall issue a written order of violation of § 6108 subject to civil penalties of this Code and enforcement shall be by the City Attorney or his designee, and appropriate action by the Carmel City Court. (b) The form of all notices shall be issued pursuant to the provisions of I.C., 9-22-1-11. (c) Any person who is judged to have violated the provisions of this Code is subject to a fine of up to $500 in addition to towing and storage charges. (d) All provisions and respective civil penalties are designed for enforcement through the Carmel City Court. ('91 Code, § 6-118) (Ord. This division does not apply to: (a) A vehicle in operable condition specifically adapted or constructed for operation on privately owned raceways; (b) A vehicle stored as the property of a member of the armed forces of the United States who is on active duty assignment; (c) A vehicle located on a vehicle sale lot or at a commercial vehicle servicing facility; (d) A vehicle located upon property licensed or zoned as an automobile scrap yard; or (e) A vehicle registered and licensed under I C., 9-18-12, as an antique vehicle. An owner or lienholder who claims a vehicle impounded and declared abandoned by the Carmel Police Department shall be charged a towing fee and a per day storage fee. On October 24, 2008, a site visit was performed in which the following City Code violations were documented: The conditions outlined in Section 6-159(h) of the Carmel City Code indicate the above - mentioned structure is an Unsafe Building. (1) Is in an impaired structural condition that makes it unsafe to a person or property; (2) Is afire hazard; (3) Is a hazard to the public health; (4) Is a public nuisance; (5) Is dangerous to a person or property because of a violation of a statute or ordinance concerning building condition or maintenance; (6) Is vacant and not maintained in a manner that would allow human habitation, occupancy or use under the requirements of any statute or ordinance; (7) Has any door, aisle, passageway or other means of exit that is not of sufficient width or size or is not arranged so as to provide safe and adequate means of exit in case of fire or panic, (8) Has the walking surface of any aisle; passageway, stairway or other means of exit so warped, worn, loose or otherwise unsafe so as not to provide safe and adequate means of exit in case of fire or panic; (9) Has stress on any material, member or portion thereof, due to dead and/or live loads, that is more than one and one-half times the working stress allowed for new buildings of similar structure, purpose or location; (14) is or has any portion thereof that, because of (1) dilapidation, deterioration, or decay; (2) faulty construction; (3) the removal, movement, or instability of any portion of the ground necessary for the support of such building; (4) the deterioration, decay, or inadequacy of its foundation; or, (5) any other cause., is reasonably likely to partially or completely collapse; (15) Is or has any portion thereof that is, manifestly unsafe for the purpose for which it is being used, (16) Has exterior walls or other vertical structural members that list, lean or buckle to such an extent that a plumb line passing through the center of gravity does not fall inside the middle one-third of the base; (17) Shows, exclusive of its foundation; thirty-three percent (335,6) or more damage or deterioration of any supporting member, or fifty percent (50516) or more damage or deterioration of any non -supporting member, enclosure or outside wall or covering; (18) Has been so damaged by fire, wind, earthquake or flood or has become so dilapidated or deteriorated so as to become (1) an attractive nuisance to children, or (2) freely accessible to persons for the purpose of committing unlawful acts; (19) Has been constructed, exists or is maintained in violation of any specific requirement or prohibition applicable to such building or structure provided by any law of the State of Indiana or any City ordinance or building regulation relating to the condition, location or structure of buildings; (20) Has, whether or not it was erected in accordance with all applicable laws and ordinances, in any supporting part, member or portion, less than fifty -percent (50%), or in any supporting part, member, or portion, less than sixty-six percent (66%), of the (1) strength, (2) fire -resisting qualities or characteristics, and/or (3) weather -resisting qualities or characteristics that would be required by law in case of a newly constructed building there -at of like area, height and occupancy, (21) Is used or intended to be used for dwelling purposes and, because of inadequate maintenance, dilapidation, decay, damage, faulty construction or arrangement, inadequate light, air or sanitation facilities, or otherwise, is determined by the Hamilton County Board of Health to be unsanitary, unfit for human habitation of in such a condition that it is likely to cause sickness or disease; or (24) Is abandoned for a period in excess of six (6) months, so as to constitute an attractive nuisance or hazard to the public. Furthermore, abandoned vehicles are being stored on the property. It is a violation of Carmel City Code § 6-114 which states: "Because of the danger to the health from vermin, the danger of personal injury to children attracted by such vehicles, danger of fire by the storage of gasoline and oil thereon, any abandoned, unlicensed, inoperable, disassembled, wrecked or junked motor vehicle on any street or public property for more than five days or upon any private property for more than 15 days, except as hereinafter provided, is declared to be a nuisance and unlawful." The vehicle located at the rear of the property can be stored inside a completely enclosed garage legally. If it continues to remain where it is now located, further enforcement action may result which can include an appearance in Carmel City Court and the assessment of fines. The inspection also revealed the use of this abandon vehicle as a trash receptacle, with trash and debris escaping from the vehicle and blowing into surrounding areas. This constitutes a violation of the Carmel City Code, §6-77(k), which construes the following conditions to be public health nuisances: (k) Any accumulation of junk, rubbish, scrap metal, automotive parts, building materials, machinery, dead trees, or parts thereof, upon any premises in a residential area. Please secure the entries to these structures and remove the vehicle in question by November 26, 2008. Failure to complete this work within the time specified will result in the City of Carmel bringing this site into compliance.
