Regardless of the method of preservation employed we acknowledge that pursuant to the Landscape Requirements of the
Zoning ordinance the owner is required to maintain plantings meeting the requirements of Section 26.04: Perimeter Buffer
Requirements. This includes the equivalent of 3 sQade trees, 2 ornamental trees and 9 shrubs per 100' linear foot as
required by ordinance. We understand that the proposed method may result in the loss of trees in the future. We
understand that the loss of trees may require planting additional trees and lor shrubs to maintain compliance with Section
26.04 of the Zoning Ordinance.
Please let me know if this fully addresses your cOn;Jments. If so I will ask Angie to supplement the file with this and make
it part of our request.

Scott Bardenet;s going to call and discuss this with you. We will came up with an appropriate method of preservation of
the existing trees. That is our intent. If, as you no~e, the employed method fails and the existing trees die we are required
by ordinance to maintain the level of tree planting buffer identified in the Ordinance.

After the call from Scott I will supplement the file with an acknowledgement of the discussion and how the trees will be
preserved including our understanding that regardless of the method of preservation employed the property owner is
obligated to maintain the section 26.04 buffer req4ired by ordinance. We understand that this may require planting

The latest revision of the plan does not show any trees in the bufferyard on the south perimeter. The plan shows only the
general position of a 24' deep trench made 18" behind the curb line. Apparently Mr. Bordenet wants to preserve the tree
line that exists there without showing the existing trees or the method of their preservation, all the while compacting the
soil and building a parking lot up to the very edge of the tree line.
This is very problematic: doing this without identifying the trees and engineering the tree preservation methods will
probably result in the death of the existing trees. So, either the existing trees (including the ones to be transplanted and
used on site) be shown, along with a graphic detail of the preservation method to be used, or new plantings equal to the
required amount by Section 26.04 be shown. :

The City prefers that the existing tre.es be left to: fulfill the requirements for the bufferyard, but we have learned from
experience, it does not work to build to the very:edge and hope that what remains is a sufficient butler as required by the
ordinance. So the existing trees and preservatipn must be engineered and planned so that everyone on site knows of the
importance and the lengths that must be taken ro construct around them.

It is my understanding that public input is not allowed at the Special Studies committee meeting so I
am requesting that you or your staff address these issues on behalf of the residents of Woodhaven,
I

I understand that is probably impossible. for the Special Studies committee to apply the setbacks
required by the Michigan Road Overlay tone to this project, yet I find it hard to believe that when you
combine the Carmel and Zionsville Overla~ Zones, this is the only property in the middle of 4 miles of
Overlay Zone that will be allowed to encroach upon the 30 foot Greenbelt along Michigan Road.

I think it is reasonable that the Special Studies Committee require that the building be flipped to the
south side of the property to be further from the residential neighborhood. This would increase the
distance between the north property line and the crematory chimney from about 50 feet to about 190
feet and put it on the side of the building aY"ay from the houses. This should reduce the noise and the
visibility of the chimney without having a significant impact on the site plan. I have sketched this
location on the attached site plan. The reddat is an approximate chimney location, since it has never
appeared on any of the plans I have seen.'
With proper mature landscape and fence qufferipg, as well as full cut-off light fixtures this should be a
better plan for everyone.
While the white vinyl fence they propose is a solid screen, the stark white is a glare. A brown vinyl or
cedar is more appropriate for the woods ty:pe setting of the neighborhood.

Thank you so much for responding - J greatly appreciate it. I was just talking to a neighbor who informed me that the
meeting on Tuesday is just a Plan Commission 'Special Studies Subcommittee meeting' and that the public probably
won't be given another chance to speak on this matter unfortunately. I had been working on what I would say, but it
appears I won't get another chance to be heard. I pid have five minutes to speak at the Zoning Board meeting last week,
but it did not have much effect on the decision. I think the Zoning Board felt their hands were tied and they could not
'legislate from the bench' on the environmental asp~cts, or they may have been convinced by the confident assurances of
safety by the mortuary, (Hopefully the City Council can legislate on it insteadl)

crematory incinerators so close to our backyards arid our children Would you be willing to discuss the idea of a new
ordinance with the City Council? I really wish there was a way to delay Tuesday's vote on approving the Illor.tuary's plan,

expert to a U.S. House subcommittee:

EPA estimates of total mercury emitted as a byproduct of cremation of human' remains to be around 0.3 tons per
year. However, EPA's estimate might sighificantly understate the magnitude of mercury emissions from
this source as well. A newly published arti~le, authored by an EPA environmental scientist, estimates
mercury emiSSions from cremation to be ten times more than the EPA estimate, about 3 tons per year H'
Indeed, today the Mercury Policy Project jNill testify that total actual mercury emissions could be as much as 5
to 6 times EPA estimates. Why is this important? It is important because EPA prioritizes its activity based in
part on this number.
In short, the most important point to keep in mi~d is that the EPA's past estimates on the mercury emissions from
crematories may have been wrong by a factor of i10 and scientists are testifying to this in front of the US Congress.
Any statements by the cremation industry that 'the EPA isn't worried'. 'emissions are minimal' and 'are a non-issue' are

I can work with the engineer on this and provide ani additional parking space. We show 128 and require 127. I will ask
them to add one space and we will then meet what may be viewed as a conservative interpretation of the ordinance but
that is ok. I
I do not want staff to feel like they are stretching the rules even if we agree that it is accessory to the primary use.
One otl]er thing I noticed this morning is that the en~gineer has shown bumper stops. I have let them know that the
parking area needs to be fully curbed. I

Attached is the petitioner's graphic tha1 shows the distinction between the publidloor area and private floor area of the
proposed Nelson Mortuary. The parking ordinance,1 chapter 27, states thata funeral home/mortuary/crematorymust have
one parking space per 50 square feet of pUblic floor area. This is unique in the fact that i1 acknowledges a distinction
between public and private floor area, where this is,not required for a retail or office use.
The Department agrees with the petitioner's determination that a maximum of 6,341 sq ft of the proposed building will be
considered public floor area, which means that 127: (or less) parking spaces are required. The dwelling use on the
second floor is considered an accessory use, since it is tied"to the primary mortuary use. A11east one parking space is
allotted toward that accessory use.

A. Cremations -About 200 cremations per year are anticipated, about 50 of which
involve a memorial ser+ce. The memorial service usually involves 20 to 50
people, lasts 2 to 3 hours and occurs generally between 4 p.m. and 7 p.m.

B. Funeral-Jewish Tradition

1. It is considered disrespectful to not qiIickly bury the body. As such,
funeral arrangemehtk are typically made on the date of death, and calling
and burial are eithet the following or the next day. Because the body is
quickly buried, embAlming is the exception, and there is rarely visitation.

2. Traditional Jewish fiunerals involve burial and no embalming. About 80
. I
JewIsh funerals per I year are expected. About twenty percent (20%) of
these result in gra~e-side services and will not, therefore, involve a
procession that startJ at a funeral home. About 80% (about 64 per year) of
these will not invdlve grave-side services and will include a funeral
procession beginnink at the funeral home. The funeral processions start
during the day, ty.pically at 11:00 a.m. or 2:00 p.m. and, as such, do not
occur at a.m.lp.m. p~ak hours. This is the only larger gathering that occurs
at the funeral home Ln connection with the traditional Jewish funeral.

c. Funeral-Non-Jewish Tra!dition:
1. The non-Jewish tra~ition, custom and practice involves a greater time
between death and burial or cremation.

2. The non-Jewish tradition, custom and practice typically involves a calling
and a funeral proces~ion, both of which originate at the funeral home.
3. A non-Jewish funert home typically has a higher volume - there may be
multiple showiog i rooms aud funerals occurring simultaneously.
There has been inquiry about the eremation process and emissions. In .this regard, the
following are notewOlthy:
A. The crematorium inj which the body is cremated contains a (i) primary
chamber, (ii) seconaary chamber and (iii) a stack from the secondary
chamber.
B. Essentially; the process is as follows:
L The body il cremated iOn the primary chamber. In that a body is
85% water,l this is primarily an evaporation process.
2. The gases,. which fuel the burner are then oxidized m the

secondary qhamber.

3. After this o~idation process, what remains is released through the
stack. I
C. What is entitted froL the stack is primarily gases, including (i) carbon
monoxide, emitted ~t the rate of 0 to 20 parts per million, (ii) nitrogen
oxide, which result~ from combustion of the fuel and not the body and
which is emitted at the rate of about 0.38 pounds per hour and (ili) sulfur

dioxide which, again, results from combustion of the fuel and not the body
and is emitted at the!rate of about 0.11 pounds per hour. Also emitted are
(i) other organic compounds, at the rate of 0.003 pounds per hour and (ii)
particulate matter, ht the rate of 0.01 pound per hour. All of these

entissions fall far below regulated thresholds.

Yes we can consider the canopy as part of the building frontage when calculating the permitted size for a sign.
The initial measurement was based off of the site plan, which only shows the canopy as a dashed line that is not shaded
in. But since you pointed out that the canopy is part of the building, as shown on the building elevations, we can use that
measurement instead.
