I have received your comment letter dated Odober 2nd, 2008. A copy of this letter is attached. I have the
following responses which match your numbered comments:
1. Acknowledged.

4. The indirect outlet permit is being prepared and will be submitted to your office once a warranty deed
is obtained.
5. The detention outlet seems to discharge to a qualif}ing natural surface watercourse as indicated in
Hamilton County Ordinance 4-26-99-C(2). Attached is a basin map shov.r:ing the 8.9 acres
contributing to this water course and contours defining this water course. Also attached are
calculations further analyzing the existing site conditions. The following chart summarizes them:

Although the existing site does not di scharge through a pipe or other improved structure, the
indicated discharge amounts from the parking area (east sub~basin) do create a shallow-concentrated
discharge. This is especially true when they are received in the defined water course at the property's
northeast comer. Considering that the existing site releases to a point source discharge in a
qualifying open water course and that this site will reduce the discharge to that point, I believe this
outlet ,:viII now be deemed acceptable.

Dear Mr. Bordenet:
We have reviewed the constmction plans submitted to the Hamilton County Surveyor's Offic~
on Scptcmber 22, 2008, for this project and have the following comments:
1. The proposed project falls in the unincorporated area and MS4 jurisdiction of
Hamilton County.
2. The proposed project DOES NOT fall in a Carmel Wellhead Protection Zone.
3. The proposed project does not fall in the Woodhaven Regulated Subdivision Drain
Watershed, but does drain through the WoodhavenRegulated Drain.
4. Please submit an indirect outlet permit, for the discharge into the Woodhaven
Regulated Drain, to this office. The application is available on our website at
http://www.co.hamilton.in.us. go to Departments, Surveyor, and Forms.
5. Hamilton County Ordinance 4-26-99-C(2) prohibits the outlet as you have it
designed. While it is true part of the site drains to the same point .in the existing
conditions, this proposal increascs the drainage area to that point and changes the
flow from surface flow to point source discharge. This proposed outlet is not deemed
acceptable by HCSO.
6. HCSO has the following suggestions for a possible acceptable outlet point:
A.) Contact the adjoining property owner oftot 3 in Woodhaven to negotiate a
30' easement for an extension of the regulated drain to your proposed pond
outlet structure. Then design a regulated drain extension that provides
drainage for your site and accommodates any drainage in that area of
Woodhaven.
B.) Contact Altum Nursery and negotiate a private drainage easement that routes
your site discharge poiIit through their eastern most pond. This provIdes ~n
outlet point that is then piped all the way to the main open channel and
redirects drainage away from a problem subdivision. The dry detention basin
would need to be redesigned to put the outlet in the SE corner but this would
provide a deeper outlet point. Some additional engineering work maybe
required to verify the Altum ponds can handle the additional flow, but it
should work as you are removing existing drainage area from the ponds.
7. Please address any Phase 11 comment from HCSO Program Manager, Bob
Thompson, along with these comments.
8. Please note that further comments may be necessary at a later date.

Dear Mr. Bordenet,
I have reviewed the plans you sent me concerning the above referenced project. The plans
are stamped with the license number of 19900113, and the name of D. Scott Bordenet. The sheets
are labeled C1.0 thru C5. While Duke Energy does not own an exclusive easement in this area, we
do have a 69,000 volt line in the project area. This line is designated as our 69155 line and poles in
the project area are numbered 838-6358 and 838-6357. Duke Energy does not object to your use of
this area for your project.
Duke Energy offers the additional guidance to help you accomplish your work in a safe manner and to
protect the reliability of our transmission lines:
III Please erect a barrier fence around all Duke Energy poles where grading will be done within 25
feet.
III Any damage to the line and or structures and claims due to the damage is the responsibility of the
contractor/owner.
III Duke Energy encourages you to post signs reminding all drivers to make sure dump beds are
completely lowered when crossing under power lines.
Duke Energy also offers the following comments to ensure that other potential conflicts are not
created during construction.

Energy would like the opportunity to review these changes for compliance.
e Proper clearances must be maintained. If any construction work by Duke Energy is required to
maintain proper clearances, the cost will be the responsibility of the developer.
In not objectIng to the use of the right-of-way for use as shown on the drawings; Duke Energy is not
relinquishing the right to protect and maintain this line as specified in the agreements. Any damage to
the poles or lines and claims caused by the damage is the responsibility of the developer. It is the
responsibility of the contractors to ensure all pe~sons working near the transmission lines are made
aware of the safety hazards associated with this line. Please consult all OSHA regulations for working
in areas involving power lines.
I have attached a copy of the right-ot-way restrictions as well as the approved plantings list for
your future use, should you be using any Duke Energy easements on other projects.
