We offer the following comments: GENERAL INFORMATION 1. These comments represent the Department of Engineering's frrst review of the Site Preparation construction plans for this project. 2. We request that all responses to our future comments be provided in writing and be accompanied by drawings reflecting the requested revisions. Failure to provide written responses may result in the delay of the review process. 3. It is critical that this office be made aware of all modifications made on the plans being re- submitted, particularly if any such changes are considered "new" or fall outside of our previous reviews. Please notifY us of any changes and specifically state any changes, including changes resulting from Plan Commission, BZA or other committee meetings. 4. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage calculations submitted to this office for review. As we discussed previously, submittal to Crossroads is not required for this project. 5. Final drawings will not be approved for construction until: a. All Engineering Department and Utility Department and Hamilton County Surveyor issues have been resolved. b. All bonds and performance guarantees are posted. c. All Board of Public Works and Safety approvals and any other governing agency approvals (if required) are obtained. d. All off-site easements necessary to install utilities to serve the development are secured. e. Any required fees are paid in full. f. Required digital files have been submitted. . 6. The Department reserves the right to provide additional comments based upon subsequent reviews as more detailed information is submitted. 7. An approved Storm Water Management Permit is required prior to commencing any earth disturbing activity. 8. An approved right-of-way permit is required prior to commencing any work in the public right-of-way. 9. If it will be necessary to relocate existing utilities or other infrastructure, the costs for such relocations are to be borne solely by the developer. Any utility poles required to be relocated within the right-of-way shall be relocated to within one foot of the proposed right-of-way. 10. Compliance with the Thoroughfare Plan includes construction of the improvements prescribed by the Thoroughfare Plan as well as dedication of that additional right-of-way outside of the existing right-of-way to meet the half right-of-way width prescribed by the Thoroughfare Plan across the frontage controlled by the development (including sections with no access). However, compliance with the Thoroughfare Plan is not required due to the-nature of this project. 11. The Department requires that the construction drawings be developed in accordance with the City of Carmel digital submission standards and that all required submittals for primary plat, secondary plat, and construction drawings be made. The digital files must be submitted to the Department of Engineering prior to the approval of the construction plans. Please contact the City GIS Department for the requirements. 12. Jurisdictions: a. The project site is located within current City of Carmel Corporate Limits. b. Streets and Right of Way - City ofCarrnel (Rangeline Road) c. Water - City of Carmel Utilities d. Sanitary Sewers - City of Carmel Utilities e' Storm Sewers/Drainage - City ofCarme1. f. Legal Drains - Hamilton County Surveyor's Office. 13. Drawings submitted for approval: a. The design engineer must certify all drawings submitted for final approval. b. This office will require a minimum of 5 sets of drawings for approval after all issues have been resolved. The drawings will be stamped as approved and signed by the City Engineer and by Carmel Utilities. The Owner will receive 1 set which must be maintainedort the construction site at all times. If additional approved sets are desired, we will approve a maximwn of2 additional sets. However, the additional sets must be submitted with the required minimum 5 sets. 14. Carmel Utilities wiD provide separate reviews of this projectfor water and sanitary sewer issues. Performance/Maintenance Guarantee Release Procedure d. Engineering Requirements for Building Permit Approval e. Commercial pennitting Procedures f. Utility Jurisdictions/Right of Way Permit g. Water and Sanitary Sewer Fees BOARD OF PUBLIC WORKS AND SAFETY 17. I am enclosing a schedule for Board of Public Works and Safety meeting dates and agenda deadlines for your use. Please use the Engineering Department deadlines for submissions to the Board. t 8. Any submission to the Board requires prior approval by tbe Carmel Clay Plan Commission and/or tbe Board of Zoning Appeals (if applicable) and completion of review by the Tecbnical Advisory Committee. All written requests to be placed on tbe Board's agenda must include the appropriate Docket Number and the date (or dates) of approval by tbe Plan Commission. and/or the Board of Zoning Appeals (if applicable). 19. Water and Sewer Availability (EDU) approval from the Board is based upon the usage of the proposed buildmgs within the development. Reference item #34 below for a more detailed explanation. Commercial Curb Cut Approval - Reconstruction of the existing drives requires Board approval even if replaced in kind. 21. Temporary Construction Entrance - The use of one of the existing entrances for construction traffic requires approval from the Board. 22. The installation of any permanent:, privately owned and/or maintained improvement (signs, decorative street signs, walls, streetlights, etc.) within dedicated right of way or dedicated easements requires the execution of a Consent to Encroach Agreement between the Owner and the City of Cannel. Such agreements are executed by the Board of Public Works and Safety. The City Engineer may approve irrigation system agreements. 23. Secondary Plat approval if applicable. All performance guarantees must be posted prior to submission ofsecondary plats for Board of Public Works and Safety approval. 24. Dedication of Right of way if applicable. 25. It appears that there may be open pavement cuts of City Center Drive for the Water Main relocation. If so, these cuts would require Board approval. These cuts sball be indicated on the demolition plan for removal and on the site (or utility) plan for restoration. Please indicate sawcut pavement removal. The street cut shall be restored in accordance with the City's standard Street Cut Patch detail. This detail must be added to the plans. BONDING REQUIREMENTS 26. Upon initial review, it appears Performance Guarantees shall be provided for the followmg: a. Erosion and Sediment Control and Storm Water Quality. Please contact Amanda Foley, Engineering Department Stonnwater Administrator, for details regarding engineer's estimates/performance guarantee requirements for these items. b. Any work in the right-of-way (drive reconstruction or re-paving, sidewalk, streetscape, etc.). Please contact Cannel Utilities to determine if Performance Guarantees for Water Mains and Sanitary Sewers will be required for this project. 27. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100% of the cost ofIabor and materials to construct the individual improvements, to be provided by the design engineer. Please provide detailed Engineer's Estimates for each improvement including quantities, Wlit costs, pipe sizes and materials, etc. 28. Upon completion and release of individual Performance Guarantees, a three-year Maintenance Guarantee will be required. The Maintenance Guarantee amount is based upon l5% of the Performance amount for Streets and Curbs and 10% of the Performance amoWlt for all other improvements. 29. Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of Credit. 30. Please reference the available enclosures for more detailed explanation of our procedures. RIGHT OF WAY PERMIT AND BONDING 31. Any work in the dedicated right of way of Rangeline Road will require an approved Right of Way Permit and a License & Permit Bond. 32. The bond amount is determined by the number of instances of work in the right of way at $2,000.00 per instance. However, if the work is included in the scope of work ofa required and posted Performance Guarantee, the Performance Guarantee may be used to satisfy the bond requirements of the Right of Way Permit. 33. Please contact our Right of Way Manager, Fred Glaser, to arrange right of way permitting and bonding. AVAILABILITY AND CONNECTION FEES 34. New water related fees have been authorized effective July 2,2007. The revisions are: a. Tap Inspection Fee-An $86.00/].0 EDU tap inspection fee shall be charged for each new user within Cannel's water system. Thus, $1,310.00 Water COlU1ection Fee/l.O EDU plus Water Inspection Fee of $86.00/1.0 EDU = $1,396.0011.0 EDU Total. b. Development Application Review Fee- This fee will be assessed at the time the Water Availability Fee is paid. The review fee is $150.00 for single commercial, business and residential customers requiring a water connection and $300.00 for developments with more than one customer requiring a water connection. The latter fee of $300.00 would be applicable to this project. c. Water and Sanitary Sewer Availability (acreage) Fees 1 Connection Fees Please contact Carmel Utilities regarding these fees. 35. If an irrigation system is planned for this development, additional Water Availability Fees and Water Connection Fees will be assessed based upon the size and usage of the system and upon the recommendations of the Director of Carmel Utilities. SITE PREPARATION CONSTRUCTION PLAN REVIEW COMMENTS 36. General Comments a. The City has adopted a new curbing policy. All new curbing installed by this project shaH conform to this policy. Please revise any notes, specifications, and details to accommodate this policy. The language of this policy must be added to a specification sheet on the final construction plans. 37. Stonn Water Management a. Due to the nature of this project and the fact that there is no increase to the amount of existing impervious area, the Department is not requesting the installation of stann water management facilities. b. The total disturbed area is indicated to be 0.27-acres and includes aspects of Land Altering activity as defined in Section 10] .03 of the Stonn Water Technical Standards that the Department was not aware were being proposed during previous discussions. This area is above the 0.25-acre threshold above which the City's standards become applicable (not the O.S-acres indicated on the plan sheet). Due to this fact, a construction erosion and sediment control plan must be developed for this project and a storm water quality system must be installed. Given the limited ability to treat the stormwater, the Department would be willing to support a variance from the City's requirement for two BMP's in series if one measure was proposed. Options for this measure include the installation ofa hydrodynamic separator or replacement of the existing on-site inlets with catch basins and hoods. 38. On the cover sheet, please remove the contact information for the Clay Township Regional Waste District. 39. On the cover sheet, please correct the name ofthe Hamilton County Surveyor. 40. On the cover sheet, please replace the contact information for the Hamilton County Highway Department with the contact information for the City of Carmel, Department of Engineering. 41. On the cover sheet, please remove the note referencing the Town of Fishers Construction Specifications and Standard Details. 42. Sheet C801 - Please replace the CONCRETE STRAIGHT CURB detail with the City of Carmel standard detail available on the City's website. 43. Sheet C801, CURB JOINT DETAIL - Please indicate the maximum spacing between transverse expansion joints to be 50 feet instead of ]00 feet. Also indicate that the maximum spacing of transverse contraction joints is 10 feet on tangents and 5 feet on radii. 44. Please remove all of the lighting, landscaping, and architectural sbeets from the sets of drawings to be approved by the Department of Engineering. Also remove the titles of these sheets from the Drawing Index on the cover sheet. 45. Please confrrm that it was not possible to reduce the width and limit the access to "right-out only" at the northernmost Rangeline Road curb cut as previously discussed. 46. Please provide a maintenance of traffic plan for the drive reconstructions. Such plans shall conform to the INDOT Work Zone Safety Manual. 48. Please confirm if any existing streetscape is being affected by this project. 49. Please verify that the portions of the entrances within the right-of-way shall be 7-inch concrete per the detail on Sheet C80 1. 50. Please verify if there are any proposed modifications to the existing ADA ramps in the right- of-way included in this project. 51. The portions of any utility installations or relocations within the right-of-way shall be backfilled in accordance with this Departments standard and shall satisfY the minimum cover requirements. These notes need to be added to the plans. Please contact this office to obtain the standard notesllanguage. 52. Please add a note to each sheet that no earth disturbing activity may take place without an approved stann water management permit. 53. Please add a note to the drawings as follows: "All paving within the existing and proposed City right-of-way shall confonn to the requirements of the Department of Engineering. The Contractor shall contact the Department of Engineering to schedule a pre-construction meeting to review the Department's construction requirements, staff notification requirements, required inspections for certain stages of the work and to review the authority of the Department as it relates to work within the existing and proposed City right-of-way." II doesn't sound like the petitioner has any intention of following the overlay. Is there a threshold at which ADLS amend petitioners must meet the Overlay? On a very quick pass through the overlay, it looks to me that all ADLS petitions need to come to full plan commission for a public hearing... Is that right??? Shell - History: III A few months ago the guidelines committee meeting took a peak at this for Mike, and we agreed that moving the building to the street was the best choice. o One point of discussion at the time of renewing the RR-Carmel Dr overlay was that we needed the overlay to be renewed for another year for this particular project. Now: III Most of this site is being demolished: III All the pavement, landscaping & much of the equipment will be demolished. III All but2 signs, lighting fixtures and canopy columns wili be bull-dosed. G Most of the building will be demolished: ill 60% of the existing building exterior walls will be demolished. III All the interior of the existing building will be torn out. III So many structural walls are to be removed that there is no way that the existing roof could stay up. Concern: This is a MAJOR renovation. Why are they not required to meet the overlay? The Dept Report is vague. If they are allowed to get a variance here, will Pizza Hut and others be able to do the same? Future Idea: There are many ways to determine when a building can be grandfathered based on the amount or cost of a renovations including: · % square footage increases (DP has this for this overlay, but not ADLS) · % of building value compared with cost of the addition/renovation · % of floor area being remodeled in an existing building · size of construction cost. If the overlay is to be renewed again, or made permanent, we should probably discuss thresholds like these. Thanks for all your help!!! Comments and concerns are as follows: 1. Please provide details on outdoor storage to be used, if any, for items like bagged ice, kerosene, etc. 2. Please provide details for vacuums and air hoses, iflhey are going to be used. 3. When submitting packets for Board review, please include an elevation indicating what the west elevation of the building will look like when it is approached from West Carmel Drive. Include any infol111ation about illumination, etc. 4. Will any hoses be provided outside to help wash down sidewalks etc? If so, w11ere will they be located? 5. Please provide an elevation (east side only is fine) indicating to what extent rooftop mechanicals are screened. 6. Please consider adding a transom element above the doors to match the element above the wiildows. 7. We would prefer to see a full side\valk connection extended along the south side of the site for pedestrian access, rather than a striped section of pavement.. Access to the dumpster and vendor parking could be accomplished with a rolled curb. 8. Please consider moving the north sidewalk access east of the ingress/egress, and eliminating the sidewalk connection from the public sidewalk to the bike parking section. Tills wouLd also reduce the amount of impervious surface, by about 50 linear feet, as well as address some of the grading concerns. 9. For the canopy replacement, please consider adding a cornice element, similar to or matching the comice on the building. 10. Please note, if it is necessary to move the existing ground signs to help accomplish needed site improvements, or to make the signs more visible, this could be considered by the Department as an extension of the original sign variances, depending on the final location. Unfortunately I shared the positive results of our last meeting with Circle I need a clarification on the determination that this is not a remodel and addition. As we previously discussed, if it was a new structure, we would have designed it significantly different and Slightly relocated from this plan. Our plan follows the meeting that we had with you and Mike a few months ago. Do we have some definitive definitions you are relying on in this determination? Additionally, if we decide to construct as you now suggest, what support do we have from planning Staff and the Mayor's office with this long list of variances? It sounds like too much of a long shot. I know you cannot guarantee how the BZA will react to this, but I need to know what your office believes and how much support we will have to move forward with this expensive process. The Overlay provides for 50% expansions of existing structures. On the positive side, this means you're no longer constrained by the 50% requirement, and can build a larger building. The variances you would need 1. Multiple signs facing the 2. Build-to line--this would Building height under 26'. 4. Number of stories (2 useable stories required) 5. FAR under minimum of .5 6. >70% street frontage 8. Location of parking Plus the DP and ADLS Amend, which can go through concurrently with the variances. to file are as follows: ROW include both the building and the canopy, as one variance 3. We also have the following suggestions for the building and site. We think the design is nearly there, but there are some details we'd like to see that will take the building to the full level of following the intent of the Overlay. They are: 1. Increasing the size of the cornice 2. Using fluted or otherwise decorated columns at the entrance--the color is fine, but we'd like to see more detailing. 3. More window trim--either painted to match or contrast with the brick, or lintels/sills, etc. 4. More prominent belt course, perhaps placed higher on the building and in a more visible/contrasting color to emphasize. 5. Goosenecks instead of internal illumination, on both the Circle K signs and the canopy columns. 6. White canopy, with either the Shell name/stripe, or the scallop logo, instead of yellow (yellow perhaps as accent). 7. Darker/more red brick, perhaps to highlight/emphasize the red in the logos. Also, the plan Commission and BZA are likely to ask for green building elements. Some elements that could make a big difference in terms of energy usage etc would be a solar canopy; skylights (studies have shown they increase sales by up to 40%); additional windows in the office area; and a white or light membrane roof. We realize this is not necessarily what you would prefer to hear. There are still some concerns in the Mayor's Office regarding the site design of this project, as well. We will be more than happy to work with you on this project and answer any questions that may arise as it moves through the process, but unfortunately we cannot guarantee the outcome of the process. That as we discussed on the phone is not correct. The current building is 1901sf and the proposed building is 2849sf. This does keep us under the 50% as laid out in the ordinances regarding the overlay. We are technically allowed 2851.Ssf before the construction would be considered to be over 50% of the existing building. I look forward to speaking with you tomorrow regarding the results of the meeting and finding out for sure for our filing purposes the status on the canopy and a clearer picture of the variances that we will be needing.
