RESOLUTION OF THE CITY OF CARMEL BOARD OF PUBLIC WORKS AND SAFETY
APPOINTING APPRAISERS FOR THE INSTALLATION OF ORNAMENTAL STREET
LIGHTING IN THE HUNTERS CREEK VILLAGES SUBDIVISION
WHEREAS, I.C. 36-9-38 (the "Act") permits the Board of Public Works and Safety of the City of
Carmel, Indiana (the "Board"), to establish within the boundaries of the City of Carmel, Indiana (the
"City"), improvement districts to provide for the construction of certain public improvements and to
assess the cost of.completing such improvements on property owners which benefit from the constructed
improvements; and
WHEREAS, on or about April 7, 2004, the Board adopted Resolution No. BPW-04-07-04-02 (the
"Declaratory Resolution'), accepting a petition (the "Petition") requesting: (i) the establishment of an
improvement district pursuant to the Act, consisting of a portion of the area known as "Hunters Creek
Villages", located generally southeast of the intersection of 146`h Street and Oak Ridge Road, west of
Rohrer Road and north of Nevelle Lane, including all or a portion of the streets: Bennett Court, Bridle
Circle, Bridle Court, Winter Way, Winter Court, Saddleback Drive; and part of Howe Drive, Bennett
Road, Oak Ridge Road, and 146`h Street, all in the City of Carmel, Hamilton County, Indiana. (the
"District'), and (ii) the installation, maintenance, and operation of a system of ornamental street lighting
in the District (the "Project'); and
WHEREAS, following a public hearing on or about October 4, 2006, the Board adopted
Resolution No. BPW-10-04-06-01 which: (i) confirmed the Declaratory Resolution and established the
District as an improvement district pursuant to the Act, (ii) approved the plans for the Project and.ordered
the completion of the Project, and (iii) found that all real property within the District is subject to
assessment of special benefits and damages by appraisers appointed by the Board pursuant to the Act and
that the assessments are subject to review in a hearing before the Board; and
WHEREAS, the Board desires to appoint appraisers to assess the special benefits and damages of
the Project pursuant to I.C. 36-9-38-22.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works and Safety of the City
of Carmel, Indiana, as follows:
Section 1. The foregoing Recitals are incorporated herein by reference.
Section 2. The three (3) appraisers set forth on the attached Exhibit A, each of which is a licensed
real estate broker, are hereby appointed to determine, pursuant to I.C. 36-9-38-22, the special benefits and
damages, if any, that will accrue to each parcel of real property in the District from the construction of the
Project, and the benefits, if any, that will accrue to the City generally from the construction of the Project.
The appraisers shall file the assessment roll with the Board not later than thirty (30) days from the date
hereof, unless otherwise approved by this Board.

Section 3. This Resolution shall be in full force and effect upon its adoption.
