Cripe Architects & Engineers 7172 Graham Road Indianapolis, IN 46250 RE: Opus North Landmark @ Meridian Building #2-lProject Review #1 Dear Ms. Forney: The City has received your construction plans submitted for review at the September 19,2007 Technical Advisory Committee meeting. We offer the following comments: GENERAL INFORMATION 1. These comments represent the Department of Engineering's. first review of the construction plans for this project. We reserve the right to provide additional review comments as detailed construction drawing are developed for this project. 2. We request thatall responses to our comments be provided in writing and be accompanied by a drawing reflecting the requested revisions. Failure to provide written responses may result in the delay of the review process. 3. It is critical that this office be made aware of all modifications made on the plans being re- submitted, particularly if any such changes are considered "new" or fall outside of our previous reviews. Please provide revised plans including all revisions. Please notify us of any changes and specifically state any changes, including changes resulting from Plan Commission, BZA or other committee meetings. 4. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage calculations submitted to this office for review. If you have not already done so, please provide a set of drainage plans and calculations to their office for review. We will share Crossroad's comments as they are received. 5. Final drawings will not be approved for construction until: a. All Engineering Department, Utility Department and Hamilton County Surveyor issues have been resolved. b. All bonds and performance guarantees are posted. c. AU Board of Public Works and Safety approvals and any other governing agency approvals (if required) are obtained. d. All off-site easements necessary to install utilities to serve the development are secured. e. Digital files have been submitted. f. Water and Sanitary Sewer availability fees have been paid. 6. The Department reserves the right to provide additional comments based upon subsequent reviews. 7. An approved Storm Water Management Permit is required prior to commencing any earth disturbing activity. 8. An approved right-of-way permit is required prior to commencing any work in the public right-of-way. 9. If it will be necessary to relocate existing utility poles, they must be relocated to within one foot of the proposed right-of-way. Costs for such relocations are to be borne by the developer. 10. Typically, developers provide a commitment equal to the value to construct these improvements for deposit into the City's non-reverting thoroughfare fund. Credit is typically given towards this commitment for any widening, milling and resurfacing of the perimeter streets. Were such commitments discussed during Phase] approval? Such commitments would apply to the Carmel Drive and Pennsylvania Street frontages. I I. The Department requires that the construction drawings be developed in accordance with the City of Carmel digital submission standards and that all required submittals for primary plat, secondary plat, and construction drawings be made. The digital files must be submitted to the Department of Engineering prior to the approval of the construction plans. Please contact the City GIS Department for the requirements. 12. Jurisdictions: a. The project site is located within current City of Carmel Corporate Limits. b. Streets and Right of Way - City of Carmel (Pennsylvania Street, Carmel Drive) c. Water - City of Carmel Utilities d. Sanitary Sewers - City of Carmel Utilities e. Storm SewerslDrainage - City of CarmeL f. Legal Drains ~ Hamilton County Surveyor's Office. 13. Drawings submitted for approval: a. The design engineer must certify aU drawings submitted for final approval. b. This office will require a minimum of 5-sets of drawings for approval after all issues have been resolved. The drawings will be stamped as approved and signed by the City Engineer and by the Director of Carmel Utilities. The Owner will receive I-set which must be maintained on the construction site at aU times. If additional approved sets are desired, we will approve a maximum of 2-additional sets. However, the additional sets must be submitted with the required minimum 5-sets. 14. Please provide drawings of this project to Carmel Utilities for their review and comments. Water and Sanitary Sewer Fees BOARD OF PUBLIC WORKS AND SAFETY 17. J am enclosing a schedule for Board of Public Works and Safety meeting dates and agenda deadlines for your use. Please use the Engineering Department deadlines for submissions to the Board. 18. Any submission to the Board requires prior approval by the Carmel Clay Plan Commission and/or the Board of Zoning Appeals (if applicable) and completion of review by the T~hnical Advisory Committee. All written requests to be placed 00 the Board's agenda must include the appropriate Docket Number and the date (or dates) of approval by the Plan Commission andlor the Board of Zoning Appeals (if applicable). Water and Sewer Availability (EDU) approval from the Board is based upon the proposed use of the buildings within the project. Reference Items #34, #5 and #36 below for a more detailed explanation. If an irrigation system is planned for this development, approval for additional Water Availability must be obtained from the Board. 20. Commercial Curb Cut Approval - This approval will require a written request from the developer or the developer's engineer. The request must include 81h x] 1 exhibits of the curb cut or cuts with all pertinent data included such as radii, width, opposing existing curb cuts, etc. Was the proposed cut previously approved auhis location? 21. Temporary Construction Entrance approval if the location is at a site other than the location of the proposed permanent entrance to the development. 22. The installation of any permanent, privately owned and/or maintained improvement (signs, decorative street signs, walls, streetlights, etc.) within dedicated right of way or dedicated easements requires the execution of a Consent to Encroach Agreement between the Owner and the City of Carmel. Such agreements are executed by the Board of Public Works and Safety. The City Engineer may approve irrigation system agreements. 23. Secondary Plat approval if applicable. All performance guarantees must be posted prior to submission of secondary plats for Board of Public Works and Safety approval. 24. Dedication of Right of Way if not platted. Appropriate dedication documents are available upon request. 25. Any open pavement cuts of Pennsylvania Street and/or Carmel Drive. BONDING REOUIREMENTS 26. Upon initial review, it appears performance guarantees shall be provided for the following: a. PelUtsylvania Street Right of Way Improvements and Curb Cut Modifi.cations. This could include demolition, extension of the 10' asphalt path south to Carmel Drive, curb cut construction, any necessary restriping, etc. This would also include Carmel Drive right of way improvements if applicable. b. Water Mains c. Sanitary Sewers d. Erosion and Sediment Control and Storm Water Quality. Please contact Amanda Foley, Engineering Department Storm water Administrator, for details regarding engineer's estimates/performance guarantee requirements for these items. 27. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100% of the cost oflabor and materials to construct the individual improvements, to be provided by the design engineer. Please provide detailed Engineer's Estimates for each improvement including quantities, unit costs, pipe sizes and materials, etc. Additionallv we reauest that vou provide these estimates to this office for review at the same time or before thev are provided to tbe OwnerlDeveloper. 28. Upon completion and release of individual Performance Guarantees, a three-year Maintenance Guarantee will be required. The Maintenance Guarantee amount is based upon 15% of the Performance amount for Streets and Curbs and 10% of the Performance amount for all other improvements. 29. Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of Credit. 30. Please reference the Engineering Requirements documents for more detailed explanation of our procedures. RIGHT OF WAY PERMIT AND BONDING 31. Any work in the dedicated right of way of Pennsylvania Street and/or Carmel Drive will require an approved Right of Way Permit and a License & Permit Bond. 32. The bond amount is determined by the number of instances of work in the right of way at $2,000.00 per instance. However, if the work is included in the scope of work ofa required Ms. Michelle Forney November 26, 2007 RE: Opus North Landmark @ Meridian Building #2 Rev. #1 Page 4 of 6 and posted Performance Guarantee, the Perfonnance Guarantee may be used to satisty the bond requirements of the Right of Way Permit. 33. Please contact our Right of Way Manager, Fred Glaser, to arrange right of way permitting and bonding. AVAILABILITY AND CONNECTION FEES 34. The Availability and Coooections Fees are current as oftbis date but are subject to future revisions. a. Availability (acreage) Fees must be paid after all other Engineering Department requirements have been satisfied and prior to approval and start of construction activities. Availability Fees are based upon total pl.atted acreage or legal description acreage for the development at the current rate of$I,OIO.OO per acre for Water Availability and $1,365.00 per acre for Sanitary Sewers. Based upon the legal description on Sheet CIOO, the preliminary Availability Fees are: b. Water - 14.742A @ $1,OIO.OO/A = $ 14,889.42 Sanitary Sewer-14.742A (a>. $1.365.00/A=$ 20.122.83 Total 14.742A @ $2,375.00/A = $ 35,012.25 c. On July 2,2007, a Development Application Review Fee of$150.00 became effective. This fee is based upon developments with one customer requiring a water connection ($300.00 for two or more water connections). This fee is to be paid with Availability (acreage) Fees. 35. Connection Fees are paid with individual buildings after the infrastructure has been completed, satisfactory test results obtained and the development has been released for building permits. Coooection Fees are based upon the proposed final use of the building. Connection Fees are based upon EDUs and should not be confused with Water Availability Fees, which are acreage based. Based upon the square footage as outlined on Sheet C201, the preliminary Connection Fees would be: a. Water - 175,000 ft2 (5-story) @ 0.5 EDUs/I,OOO ft2 (Office Classification) == 87.5 EDUs 87.5 EDUs @ $1,396.00 Water Connection Fee/EDU == $122,150.00 b. Sanitary Sewers - 175,000 ft2 @ 0.5 EDUs/IOOO ft2 (Office Classification) == 87.5 EDUs 87.5 EDUs @ $795.00 Sanitary Sewer Connection Fee/EDU = $69,562.50 c. Total COIUlection Fees - $122,150.00 + $69,562.50 = $191,712.50 36. If an irrigation system is planned for this development, additional Water Connection Fees will be assessed based upon the size and usage of the system and upon the recommendations of the Director of Carmel Utilities. CONSTRUCTION PLAN REVIEW COMMENTS 37. General Comments a. This project is subject to the City's Storm Water Management and Storm Water Quality Ordinances. b. The City has adopted new curbing and paving policies. Please revise any notes, specifications, and details to accommodate these policies. The language of these policies must be added to a specification sheet on the final construction plans. c. Please provide the requisite storm water/drainage information and summary required by Section 100 of the Storm Water Technical Standards Manual on the plan sheets. d. Please contact Amanda Foley to review storm water quality/treatment requirements. e. Be advised that the Department of Engineering does not have approval authority of Landscaping and Lighting. Please do not include these items in future construction plans submitted forreview and/or approvaL Remove sheets LIOO, EI and EIA from the construction plans and from the Index on the Cover Sheet (CS). f. No part of future office building or future parking area shall be considered approved by approval of this phase of the project. Please dedicate the required additional Pennsylvania Street and Carmel Drive right of way per the requirements of the City ofCarmel20-year Thoroughfare Plan. Carmel Drive is classified as Primary Arterial with a right of way requirement of 1 50-feet total, 75-feet half. This would be from the east property line of the project to the east right of way line ofU.S. 31. This right-of~way is not indicated on the current plans. 39. Please outline and identity the limits of the Building # 1 parking improvement project on the title sheet for clarification purposes. 40. The north arrow is incorrect on the Cover Sheet (CS). 4] . Will the existing on-site drainage easement be vacated? 42. Demolition key note 1, Sheets C 10 1 and C 102: Please revise to require sawcut at the nearest joint past removal limits. 43. Please add a note to all appropriate sheets that no earth disturbing activity may commence without an approved storm water management permit. 44. The City is not requesting any widening, milling, or resurfacing of Carmel Drive or Pennsylvania Street. 45. The Department is requesting the installation ofauxiliary lanes per City standards at the proposed entrance. Sawcut of the existing pavement adjacent to the auxiliary lanes shall be indicated. City standard curbing shall be installed within limits If auxiliary lanes. 46. Please indicate all existing striping along the Pennsylvania Street frontage. A northbound and southbound left turn lane and taper shall be striped in the existing center left turn area. 47. Please add the following note: All paving within the existing and proposed City right-of-way shall conform to the requirements of the Department of Engineering. Contractor shall contact the Department of Engineering to schedule a pre-constTuction meeting to review the Department's construction requirements, staff notification requirements, required inspections for certain stages of the work and to review the authority of the Department as it relates to work with.in the existing and proposed City right-of-way. 48. City standards for a conunercial entrance is a maximum of 30 feet wide. 49. Please indicate the return radii at the entrance. City standard is to feet; City accepts 30 feet. 50. Sheets C201 and C202. Please add keynote] 8 for ADA ramp in right-of-way and revise all instances of keynote ] I for ADA ramp in the right-of-way to be keynote 18. 51. Please indicate hatching and a keynote for City standard right-of-way pavement for the portion of the entrance in the proposed right-of-way. 52. Please verify that opposing left turns are aligned with the existing Meijer cut. 53. Please provide a maintenance of traffic plan for all work in the right-of-way. Such a plan shall conform with INDOT Work Zone Safety Manual. The plan shall be specific for the work. 54. Besides drainage easement #1, are there any existing or proposed on-site easements? Do any improvements encroach in these easements? Are any tree preservation or landscaping easements overlapped by other easements (drainage, utility, other) or proposed improvements? 55. Please verify no frames or castings for any proposed underground utility are located in the asphalt path, or the proposed entrance auxiliary lanes, or any curbing. Please add a not to this effect to the plans. 56. Please indicate the removal of all portions of the existing pond within the limits of the 75- foot half right-of-way. 57. Please verify that all required building setbacks from the pond banks and the 100-yr elevation of the ponds have been provided. Such setbacks shall be labeled on the plans. 58. For building #2 and future building #3, please verify that the minimum separation distance per the Storm Water Technical Standards Manual from the U.S. 3] right-of-way, to the detention facilities is provided. 59. Will easement be provided around the ponds? Such easements shall conform to Storm Water Technical Standards Manual. 60. Sh.eet C203. Please add City standard ADA ramp details. 61. All backfill within the proposed right-of-way for any utility or other work shall comply with Engineering fmal backfill standards. (Refer to detail 10-28 on C503). 62. Is ST-71 complete? 63. Please confirm that buildings shall be slabs on grade and establish minimum flood protection grades for each building in accordance with Storm Water Technical Standards Manual. 64. Is the proposed sanitary lateral south of the proposed drive connecting to an existing lateral? 65. The existing utilities on the 500 series of plan sheets are difficult to read. 66. Is Vectren installing the gas main extension? 67. The Department assumes that the proposed grading of the portion of the site previously approved for building 2 has changed. Please verify. 68. Please revise the grading in the right-of-way at the south end to provide the grading transition onto the property to be outside of the right~of-way and not between the curb and the proposed path. The amount offill placed in the right-of-way shall be minimized. 69. Any construction access at the existing main entrance shall require a right-of-way permit. 70. Sheet C402. Please confum if any stabilization is required in the area just north ofthe culverts under Carmel Drive. 71. The Department is preparing a response to the letter dated October 12,2007. Such response shall be issued via e-mail or under separate cover, but shall address the requested variances, storm water quality, confirmation of the understanding of the overall storm water management and treatment strategy. PREVIOUS REVIEW COMMENTS Firstly, the Department wishes to resolve comments from previous reviews of the recently approved Opus North Building # 1 Parking Improvements. The email issued on November 8,2007 concerning approval of the Opus North Building #1 Parking Improvements, which read: "I will look to resolve Item 47c with the review of the Phase II plans presently being reviewed. This comment may be considered satisfied for the purposes of this review" was related to Comment #11 of my email dated 10/31/07, which read: "Previous Comment 47c. Thank you for your response. However, as previously requested, please verify the Department's lUlderstanding of the overall plan to maintain to the best extent possible the basin lines of the master plan and to acknowledge that phase 1 and phase 2 were previously approved without post-construction BMP's, that phase 3 would be designed to the Storm Water Management Ordinance, and that any portion of phase 2 directed into the south pond would be treated per e-mail dated February 1,2007 from Paula Gartner". To summarize, the original understanding was as follows: 1. In developing the remainder of the site, Cripe would maintain the existing basin lines to the best extent possible. 2. The Department acknowledged that there were no Storm Water Quality requirements for the previously approved Building 1 and Building 2 area of the site. 3. The remainder of the site (the portion ofthe site outside of the area associated with the previously approved Buildings 1 and 2) would comply with the Storm Water Quality ordinance. Any portion of the area associated with the previously approved Buildings I and 2 now modified to drain to the south pond would be treated. As it relates to Item I, provided that the final pond configuration results in detention facilities that are adequately sized for the final contributing watershed delineations and that any existing piping installed with Building 1 that are to receive nmoff from revised watersheds are confirmed for adequate capacity, this comment may be considered resolved. As it relates to Items 2, 3 and 4, please see the comments below related to the requested vanances. STORM WATER TECHNICAL STANDARDS VARIANCE REQUEST As it relates to the requested variances from the City's Storm Water Technical Standards Manual, the Department offers the following comments outlined below: 1. Variance #1: Requirement for two BMP's. Thank you for providing treatment for 68% of the site with at least one Best Management Practice. While this is indeed above the initial City goal of 41 % (per the original understanding based on the watershed delineations of 2005), the area of the site outside of the area associated with the previously approved Buildings I and 2 was to comply with the Storm Water Quality Ordinance. The Department still requires that 41 % of the site be treated by two BMP's and cannot support this variance request. While it may not be possible to design and/or construct the proposed detention ponds as part of an overall water treatment system as you have indicated, there are other options that could be considered. Also, due to the fact that the site is voluntarily over-parked from what the Ordinance requires, the Department cannot fully assess the ability to design and construct the ponds as such. The Department would be happy to work with you and the developer to evaluate options to comply with the provisions of the Ordinance. 2. Variance #2: Pond Cross Section The Department cannot support this variance due to the fact the interest of public safety would be compromised by not providing the required pond cross section. The safety ledge requirement was established as a standard for public safety. While the Department understands and is sympathetic to the restrictions of the site and the need to import fill material, these hardships cannot be weighed against public safety. As with the Variance Request #1, due to the fact that the site is voluntarily over-parked from what the Ordinance requires, the Department cannot assess if the ponds could be made large enough to provide the required detention, the required safety ledge as well as provide the required amount of excavated material to balance the on-site earthwork. 3. Variance #3: Storage Volume returned to 90% capacity in 48-hours Due to the restricted release rate, the Department will support this variance request. 4. Variance #4: Detention ofTP R/w r Mr. Graham M. This standard does not consider existing roadway drainage infrastructure or outfaIls. The City may take the necessary steps in the future to utilize this detention volume/capacity. As per Variance Requests #1 and #2, due to the fact that the site is voluntarily over-parked from what the Ordinance requires, the Department cannot assess if the ponds could be made large enough to provide the required detention. 5. Variance #5: O.I-foot drop through all stonn structures. The Department will support this variance request. If you have questions, please contact me at 571-2441. Please incorporate the foDowing remaining comments into revised plans, submit a minimum oftive or a maximum of seven sets of revised plans, and the City will approve the plans. PROJECT COMMENTS 15. Typically, the plans approved by the Department of Engineering do not include the landscaping plans or details. In this case, the Department will approve the set with this information, but Scott Brewer must approve the landscaping plan presented on the set submitted for approval prior to the Department of Engineering approving the drawings. 16. The Sheet C200 has the top edge cut off. Please ensure that the sheet submitted for approval is a complete sheet and that the north arrow is correctly indicated. 28. 29. Thank you for your response. The Department still assumes that a connection is required to the existing gas and telecomm that will require a trench in the right-of-way. If this is the case, this will require additional right-of-way pennits and bonds. Please have the contractor work with Fred Glazer. This proposed project falls within the incorporated limits and MS4 jurisdiction of the City of Cannel. 2. The P~osed project DOES NOT fall in a Carmel Wen Head Protection Zone. 3. The proposed project falls within the W.R. Fertig Regulated Drain Watershed, 4. Please submit an indirect outlet permit for the discharge into the W.K Fertig Regulated Drain. The application. is available on our website at http://www.co.harnilton.in.lJ.B., go to Departments, Surveyor. and Forms. 5. It appears the 6)tisting pond does not have a .stable outlet structure and the channel to the existing twin culverts is not stable. The construction plans do not sbow any improvem.ents planned for this area. HeSO would recommend channel improvements and stabilization of the area, along with a true outlet control structure on the pond. I have reviewed the drawings submitted 011 September 19,2007, and offer the follo\\w.g comments: ALTERNATIVE TRANSPORTATION REVIEW COMMENTS l} The City of Carmel Parking Ordinance requires that all commercial venues include bicycle parking. Bicycle parking spaces are required at a rate offive (5) bicycle parking spaces per one hunch'ed (100) automobile parking spaces with a minimum of fOllr (4) spaces and a maximum of forty (40) spaces. Please revise your plans to show the required bicycle parking spaces on your site. Please see the City of Cam1e]'s Parking Ordinance in order to determine appropriate iocations, specifications and construction details for the above. 2) Please consider pTOviding a shower and locker room facility with this building. We request that all responses to our comments be provided in writing, Failure to provide written responses may result in delay of the review process. It is critical that this office be made aware of all modification made on the plans being re-submitted, particularly if any such changes are considered "new" or fall outside of our previous reviews.
