(.J CERTIFICATION OF THE CARMEL PLAN COMMISSION'S RECOMMENDATION ON THE PETITION OF LAUTH PROPERTY GROUP TO REZONE A PROPERTY GENERALLY LOCATED NORTHWEST OF OLD MERIDIAN STREET AND MERIDIAN STREET (US 31) PURSUANT TO INDIANA CODE 36-7-4-605 ORDINANCE No. Z-459-04 To: The Honorable Conunon Council of the City of Carmel Hamilton County, Indiana Dear Members: The Carmel Plan Commission offers you the following report on the application (Docket No. 04080049 Z) of LAUTH PROPERTY GROUP petitioning the Commission for a favorable recommendation to rezone a property located northwest of Old Meridian Street and Old Meridian (US 31) from the S-2/Residence and B~3/Business Zoning Classifications to the B-6/Business Classification. The Carmel Plan Commission's recommendation on the petition of the applicant is "FAVORABLE." At its regularly scheduled meeting on October 19, 2004, the Cannel Plan Commission voted nine (9) in Favor, zero (0) Opposed, zero (0) Abstaming, to forward to the Common Council the proposed Ordinance No. Z-459-04 with a Favorable Recommendation. Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant to rc 36-7- 4-608(f)( 4), the Council has ninety (90) days to act on this petition before it becomes effective as Certified by the Connnission. No. 17-09-35-00-00-010.001, part of Tax Parcel J.D. No. 17- 09-35-01-01-005.000, part of Tax ParceLI.D. No. 17-09-35-01-01-006.000 and part of Tax Parcel LD. No. 17-09- 35-01-01-007.000 (commonly known as North Meridian Medical Pavilion), generally located northwest of the intersection of Old Meridian Street and Meridian Street (US 31) from the S-2/Residence and B-3/Business zoning classifications to the B-6/Business zoning designation. Ordinance No. Z-459-04 affects only a part or the whole of the aforementioned Tax Parcels. Ordinance No. Z-459-04 does not amend any provision of the Carmel/Clay Zoning Ordinance regarding penalties or forfeiture prescribed for a violation of the ordinance.
