the Petitioner's Application to Vacate Plat, Covenants and Public Utilities for portions of Lots 10,

11 and 12b of Williams Creek Farms Subdivision, Plat Book 8, pages 1, 2 and 3 in the Hamilton
County Recorders Office (the "Lots") based upon a finding that:

1. Conditions in the platted Lots have changed so as to defeat the original purpose of
the Lots in the plat that the Petitioner seeks to vacate.

2. It is in the public interest to vacate the Lots within the piaL
3. The value of that part of the land in the plat that is contiguous to the Lots that is not

By way of this letter, I am requesting that the enclosed correction certificate for the re-
plat of Lots 9, 10,11 and 12 of Williams Creek Fanus be placed on the February 16th agenda of
the City of Carmel Board of Public Works and Safety. The attached correction certificate will
allow the Board of Public Works members to add their signatures to the previously recorded re-
plat of Williams Creek Farms. With the prior understanding of the Carmel Department of
Community Services, Lauth proceeded to record the replat drawing prior to its approval and
signature by the Board of Works. Also, enclosed please find a paper copy of the recorded re-plat
drawing of Williams Creek Famls.
