As you know, Primrose is requesting approval of variances to allow a preschool to operate on the southeast corner of Carmel Drive and Adams Street within the Cannel Science and Technology Park (see attached aerial location map). Specifically, Primrose is seeking approval of: (1) a use variance to permit a preschool use on the property~ (2) a development standard variance to a1l0\\I for a fence taller than four feel in the tiont yard; and (3) a development standard variance to permit a reduction in the number of parking spaces (Docket Nos. 08120006 UV, 08120007 V and 08120008 V). The grant of this variance will not be contrary to the public inter-est, due to the eXistence of special condition(s) such that enforcement of the zoning ordinance will result in unnecessary hardship because: 1he proposed use IS a contemplated use In a business district and is complimentary to the existing and anticipated uses within ttle bUSiness park. 2 The grant of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: the proposed use is complimentary to the eXisting and anticipated uses within the business park and offers a valuable service and close proximity for those employees of businesses in the business park and community. 3. The use or value of the area adjacent to the subject property will not be substantia lIy affected in any adverse manner because: the proposed use compliments the nearby properties and the site design and architecture are compatible with the business park. 4. The need for the variance arises from a natural condition peculiar to the subject property because: the proposed use is desirable at 1he property's location along the Cmmel Drive corridor, within the business park. 5 The granting of this variance does not substantially interfere with the Carmel/Clay Comprehensive Plan because: the site deSign and architecture are consistent with the Comprehensive Plan through the development and deSign Criteria set forth in the City's zoning ordinances and the proposed use will serve as a compliment to the surrounding economic development corridor. DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Use Variance Docket No. is granted, subject to any conditions stated In the minutes of this Board, which are incorporated herein by reference and made a part hereof.
