HomeMy WebLinkAboutD-1928-09 Main St 20 mph speed limitSPONSORS: Councilors Carter and Rider ORDINANCE D-1928-09 CHANGING THE SPEED LIMIT TO 20 MPH ON A PORTION OF MAIN STREET WHEREAS, the City of Carmel, Indiana, has the authority to establish motor vehicle speed limits pursuant to Carmel City Code Chapter 8, Article 3, Section 8-15; and WHEREAS, the Common Council, after review of the change by the City Engineering Department, now finds it necessary to alter the speed limit on Main Street in order to protect pedestrian and vehicular traffic. NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are fully incorporated herein by this reference. Section 2. Pursuant to City Code Section 8-15, City Code Section 8-19(a) is hereby amended to include the following streets: "2) Main Street (also known as 13151 Street) from the 411 Avenue NW/SW to 41A Avenue NE/SE" Section 3. The Street Department is directed to promptly install appropriate signage consistent with this request. Section 4. All other current provisions of City Code Sections 8-19 shall remain in full force and effect and are not affected by this Ordinance. Section 5. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to,the extent of such inconsistency only, as of the effective date of this Ordinance. However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance. Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as if this Ordinance had not been adopted. Section 6. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of.the remaining portions of this Ordinance so long as enforcement of same can be given the same effect.
