This property is zoned B8, a business district. As per §19.00.02.B of the Carmel Zoning Ordinance... Architectural Design, Exterior Lighting, Landscaping and Signage. To insure the compatibility of the proposed use with adjoining areas, the Commission shall review the Architectural Design, Exterior Lighting, Landscaping and Signage (ADLS) application of any proposed use of any Lot or parcel of ground within the B-8 District prior to the issuance of an Improvement Location Permit by the Department. Once approved by the Commission the Architectural Design, Exterior Lighting, Landscaping and Signage (ADLS) shall not be materially or substantially changed or altered without the prior approval of the Commission. Specifically, this violation stems from the painting of a plywood area on the front of the store with an advertising message, thereby constituting a new wall sign without ADLS approval or permits. Please either restore the exterior to the original condition/design or apply for an ADLS Amendment by February 20, 2009. Failure to comply by the date specified will result in further enforcement action, including written citations and the requirement to appear in Carmel City Court, along with associated fines and fees.
