FundSponsors: Accetturo, Carter; Griffiths Rider, Seidensticker; Sharp and Snyder WHEREAS, I.C..36-1-3, grants to the City of Carmel, Indiana("City") alhthe.powers necessary or desirable for the.effective conduct,and operation of its`affairs and WHEREAS,.the City hasafound it desirable to self-insure for'the,worker compensation claims of its employees; and WHEREAS. itds,desirable?and prudent for the City to establish a non-reverting fund to assist it in its self-insurance of "employee"worker compensation claims; and NOW, THEREFORE. BE IT ORDAINED .by the Comrhon Council of the City of Carm"el, Indiana, as follows: Section 1. The foregoiitg,Recitals,are incorliorated herein: by,this,reference. Section 2. The,City of Carmel "Non-Reverting Worker" Compensation Self-'Insurance Fund" is hereby established; ,yhich Fund-shall be,"separate'apd distinct from any other City fund, and shall' be used for the purpose of'paying.the costs ,ofworker compensation'claims,for employees"of the City of Carmel only. Section 3. Chapter "2„Article 4, Section 2-,133; is.hereby.added to -the Carmel City Code and shall read as follows: "Sec. 2.133 Non-Reverting Worker Compensation Self-insurance Fund. There is established' a separate and distinct City "Non-Reverting Worker Compensation-Self-Insurance Fund," which shall be used for the purpose of paying the costs of worker compensation cl6ims1or City of Carmel employees only. This fund shall be administered,by the fscalofficer of the City:" Section 4. That the remaining provisions- ofCarmel City Code Chapter 2, Article 4, are not affected by this Ordinance and,remain "in+?{ull.force and.efftet. Section 5. The Non-Reverting'Worker Compensation.Self risurance, Fund.shall be.identified as Fund #302. Section 6. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. Section 8. This Ordinance.shall be in. full force and effect from and after its.passage and signing, by the Mayor and such publication as is required by law.
