Dear All:
Just to let you know: Bob Gaffer of Weihe called me this morning to make sure that everything was worked out on the
revisions to the Firestone landscape plan, which they plan to have submitted in final form tomorrow. We discussed the
options, and determined that the actual planting location of the "added" tree and shrubs will be field located in the end cap
island at the southeast corner of the property by the installation landscape contractor reference both the curb and
waterline locations. That was my suggestion. The plan does meet the ordinance requirements with the variances applied
for.

Thank you for your responses. I believe that we can make this work. Please take a look at the attached PDF down in the
SE corner of the site in the island we've been discussing for the additional plantings. There is a water easement as well
as a D&UE as you mention. The physical water line is installed right along our East property line. There are no physical
drainage or utilities either existing or proposed in the remaining area of this proposed island. Here is what I'm proposing.
We have about 6 feet of room between the curb line and water easement line. We can plant the shade tree and 5 shrubs
3' beyond the water line easement no problem. The shrubs would be outside of the 15' DBUE easement as well, but the
shade tree is slightly within that D&UE. Again, there are no physical drainage or utilities planned here and we are the last
outlot to this development. Is this an acceptable compromise given the nature of this last outlot and all of its physical
constraints to satisfy all parties involved on a 0.97 ac outlot?

Scott,
I see your point regarding the additional 4 parking spaces. We need to add another shade tree and 5 shrubs due to the
addition of the 4 parks and can commit to adding those on the site somewhere. The parking on the south perimeter was
not an addition of any impervious area by the way. The previous submittal just showed this paved area without parking
striping. We've actually increased the pervious area by adding an island on the east end of those 4 parking spaces to
help protect the parks, provide more green space and define the entrance there better. Perhaps the shade tree and 5
shrubs we need could be added there.
The 15' electrical easement came up recently in our survey research and has been reflected on the updated survey as
well. The actual electric line is on our south adjoiners property. Since we shifted our south curb line 4' to the north per
your request, we were able to shift the majority of our proposed landscaping to the north out of this 15' easement as well.
Yes we are aware of the buried telephone orrthe north line. Our neighbors have actually overlapped into our property
with their landscaping too as shown on our survey and attached picture. In fact, it appears their trees are probably on our
lot. You can see the underground telephone flags in the picture too. We had only picked up the mulch line on our
survey. If it helps, we could push our north curb line to the south by 2 feet to give more soil volume similar to what we did
on the south side. The reason I can only go 2 feet on the north side is because our main drive aisle is currently 26'.
Reducing it by 2 feet would put us at our minimum 24' wide drive aisle. Would this be acceptable to you?

perimeter, nor was I aware of the 15 foot buried electrical line easement on that perimeter as well. Are these

Thanks for the input. In case you hadn't heard, we committed to an additional 4' widening for the planting strip on the
south perimeter. This allowed us to keep a minimum 24' wide drive aisle south of the building. I just wanted to be certain
about what you meant by allowing more soil volumes in this area. Am I correct in saying that you only wanted the wider
space and were not expecting more landscaping plantings?

One of the last times I had spoken to Shaun about this site plan, I said that I did not have a real problem with it
because of the type of use and site, but I was wondering if he could add or increase the planting area along the
south side of the plat to give the trees more soil volumes. It looks as if the soil volumes you are not planting around
the building could be made up for by widening the planting strip on the south perimeter. I did not ever hear back
from Shaun on that subject.

I put some print-outs of the MEP's drawings for Firestone on your desk. They were submitted in response to the Dept's
wanting to know about mechanical screening. Apparently, they're only going to have adomestic-sized A/C unit in the
corner of the building where it forms an L, so it will be fully screened from 421 and hard to see from even that side of the
property. They're supposed to submit more detailed drawings, or at least a site plan showing the location, before the full
Commission. The Committee also tabled them when Rachel pointed out that they're going to need at least a few
variances for their signs, and that she hadn't heard from them since October. The signs are handled by Firestone itself,
not its contractors, so we're also sitting on their bufferyard etc variances until the sign issues are cleared up. Then they
can go back before the Committee, and in front of the BZA.
Hotel Indigo was sent forward with several conditions -that the landscaping be finally approved before ii goes to full
Commission, that they use stucco instead of EIFS, and a couple of others that are scribbled in my notes in the Dept
report.

Response: The design features have been considered. However due to limitations
based on the size and nature of this business, this site has been designed
with traditional pavements and a mechanical water quality unit.

requirements. Firestone's desired parking ratio is 4 parking spaces per
service bay. For the proposed building, the desired number of parking
spaces is 40. We have reduced the amount of parking spaces based on the
buildable area.
30. Comment: Signage: there are two multi-tenant ground signs along Weston Pointe Dr.
.for the whole development. Will you be using one of the sign panels?
Response: Firestone does not plan on using the multi-tenant sign.

Review and Comment (Form 1) letter dated October 20, 2008 for the above referenced project.
We have prepazed the following responses to the plan review comments listed below.
Comment: On Sheet C104 under Erosion Control Notes delete all reference to Soil
Conservation district and use "Hamilton County Surveyor's Office or
MS4"change elsewhere on plans.
Response: Revisions have been made.
2. Comment: On Sheet CI04 and C104a Section B #1 and elsewhere appropriate in
Notes and Specifications #I shall read: "Before any earth disturbing or
clearing a precon with the HCSO must take place. "
Response: Revisions have been made.
3. Comment: My calculations show .97 ac of disturbed area which is 1.0 ac so a Rule S
Permit is required.
Response: The entire site contains 0.97 ac, however the landscaped areas between the
retaining walls and Michigari Road will remain undisturbed. The proposed
connecting sidewalk will extend between the landscaped areas to the
existing sidewalk. This results in only 0.85 ac of disturbed area, which is
less than 1 acre, so a Rule 5 permit is not required.
4. Comment: Cover sheet note #1 under General Notes shall be changed. Rule S Permit
shall be obtained prior to Earth Disturbing Activity by the Owner not the
contractor.

6. Comment: What is the point of the cw•b turnouts and the end sections? I do not see a
water quality benef t, due to the short travel distance. This design appears
to have a potential for erosion between the curb turnouts and the end
sections, along with the possibility that the runoff could travel in
unintended directions. Would a different design work better?
Response: This design is intended to maintain as much cover above the storm pipes
as possible. Concrete flumes have been added to convey water from the
turnout to the end section with gut causing erosion.
