To the Members of the Board of Zoning Appeals:
This message is in reference to Docket Number 08030019 through Docket Number 08030025, inclusively.
I am sending this message due to the fact that I will not be able to be at the BZA meeting this evening. That meeting conflicts with
City Council. Thus, I would ask that this be placed into the packets for the members for this evening's meeting.
I am opposed to the granting of any of these variance requests. They each are aimed at negating the look and feel that we are
attempting to obtain and keep in the Rangeline Road area. The Plan Commission and City Council did not pass the Rangeline
Overlay Ordinance with the expectation that businesses could just set it aside because it "does not correspond with our look". On
the contrary, one of the reasons this ordinance was passed is that most corporate 'looks" are architecturally challenged, at best, and
tasteless, at worst.
The reasons provided by the petitioner's representative for seeking these variances have no merit. When the petitioner asserts that
the building will not work if it is moved up to the street, that is just not the case. The petitioner's representative asserts that this
would be a safety hazard because the fire department could not adequately work on an emergency situation if the building shielded
the driveway from the street. My response to that is that if there was a fre, the CFD would assess the situation and, if need be
would work the scene by blocking off the street with their apparatus.
The petitioner's representative asserts that proper fuel deliver could not be made if the drive was on the back of the parcel. That is
just not the case either. The tanker would simply pull in from Carmel Drive and exit southbound on to Rangeline.
The petitioner's representative has presented plans to "retrofit" and remodel the existing building and canopy. What he has
presented only serves to make the property more out of character with the high architectural standards that have been established
for Rangeline Road than the current store.
I would appreciate your concurrence in this matter and request that you deny each one of the variance requests.

Members of the Board:
This communication is to, again, reiterate my opposition to the granting of any of the requests made by,
or on behalf of, the Circle K Shell located at the corner of Rangeline and Carmel Drive regarding their
desire to be exempted from the requirements of the Rangeline Overlay Zone.
I have been presented with the plans for the reconstruction of this pumper station/convenience store.
What the petitioner wishes to do is completely contrary to the goals of the Rangeline Overlay Zone. In
their misguided attempts to portray a compromise involving the Overlay, they have made the proposed
new store even more gaudy and unattractive.
The corner of Rangeline and Carmel Drive may well be one of the five most prominent commercial
corners in the community. To allow Circle K to build this gas station in the manner in which they wish is
contrary to the work that other property owners all along Rangeline have now undertaken as they have
built and/or remodeled. The excuses that Circle K has provided for not adhering to the Overlay are:
- We don't do it this way
- This won't work for various reasons
In my discussions with them I have not been able to discern how they know the product that would
result from adhering to the Overlay, as have many other property owners, will not work. That is
because Circle K simply has "not done it this way' in the past. Thus, they have no other basis on which
to ask for the variances that would provide them with the ability to continue to do business as usual.
I would ask you to think about any of the examples of remodeled, rebuilt or new Circle K stations those
they the petitioner might site as being what they would build on this very prominent comer. They have
suggested that their station at 96`h and Allisonville is a good example. Do you want that at one of our
most prominent corners? Think about the design. Is it tasteful? Does it fit the context of the
neighborhood? As you place those stations, again in your mind's eye, on the corner in question, ask
whether this is what you want there. Think about what could someday be built on the northwest corner
of the intersection. Will you want that corner to continue as a fast food location or do you envision that
corner being comprehensively planned and developed? The design Circle K is proposing would almosf
assure the northwest corner remaining in the type of use it is now.
Finally, in the past we have not settled in Carmel for the type of design and construction that major
chains have brought to us. Look at Lowe's. Recall the Target on Michigan Road. Recall the other
national chain stores on Michigan Road. Recall that we have prided ourselves in Carmel on saying, "Do
it the way the community asks for it to be done, which is at a higher standard, or don't do it at all".
With the above in mind, I ask that you reject the requests from Circle K in their totality.

Dear Mr. Fisher:
This letter is in response to your Development Standards Variance application for the Circle
K/Shell station project. Comments and concerns areas follows:
1. Please provide details on outdoor storage to be used, if any, for items like bagged
ice, kerosene, etc.
2. Please provide details for vacuums and air hoses, if they are going to be used.
3. When submitting packets for Board review, please include an elevation indicating
what the west elevation of the building will look like when it is approached from
West Carmel Drive. Include any information about illumination, etc.
4. Will any hoses be provided outside to help wash down sidewalks etc? If so,
where will they be located?
5. Please provide an elevation (east side only is fine) indicating to what extent
rooftop mechanicals are screened.
6. Please consider adding a transom element above the doors to match the element
above the windows.
7. We would prefer to see a full sidewalk connection extended along the south side
of the site for pedestrian access, rather than a striped section of pavement. Access
to the dumpster and vendor parking could be accomplished with a rolled curb.
8. Please consider moving the north sidewalk access east of the ingress/egress, and
eliminating the sidewalk connection from the public sidewalk to the bike parking
section. This would also reduce the amount of impervious surface, by about 50
linear feet, as well as address some of the grading concerns.
9. For the canopy replacement, please consider adding a cornice element, similar to
or matching the cornice on the building.
10. Please note, if it is necessary to move the existing ground signs to help
accomplish needed site improvements, or to make the signs more visible, this
could be considered by the Department as an extension of the original sign
variances, depending on the final location.

fueling station re-imaging/renovation program in your area and others throughout the
