II is my understanding that you are considering an amendment to the project that will adjust the maximum number of units to 263, broken down into: • 171 independent living units, • 44 assisted living units, • 18 assisted living memory support units, and • 30 skilled care units. As you are aware, Section 5.1(e) of the PUD authorizes a total of 243 units (195 independent residential living units, 20 assisted living units and 28 nursing care units). As the Director, the PUD ordinance authorizes administrative power to approve and/or amend a Secondary Plat or Final Development Plan so long as the Plan is in substantial compliance with the PUD, and that any amendment does not include a Substantial Alteration of the project, meaning a change greater than 10% of the plan's total area or approved materials. While the total number of units in the amendment would be greater than that approved with the preliminary development plan for the project, the increase would be within the 10% amendment authorized to the Director and could be approved. However, it is the new mix of units which causes me pause to approve, as the PUD ordinance approved by the Carmel City Council included a higher number of independent living units, an important consideration to some voting in favor of the project. December 19, 2007 Page 2 Letter to Grcystone Communities With~th'at in mind tktis office will issue in writing an administrative approval for an amendment to the Parke Place PUD, if: a. the maximum overall increase of units is capped at ten (10) percent of that previously approved, to a total of 267; b. ,There is a maximum of 175 independent living units, a decrease of the original by ten (10) percent; c. the remaining 92 units (assisted living units, assisted living memory support units and skilled care units) maybe distributed in roughly the same number and proportion as previously proposed; and d. the final development plan is prepared in substantial compliance with the preliminary development plan and PUD ordinance previously approved. Any further increase in the overall units or decrease in independent living units will require a formal hearing to amend the PUD.
