Attached copy of Ordinance or materials which is subject of Appeal as Pettioner because: Zoning Ordinance 25.01.01.A.1 and Covenants of Johnson Acres subdivision The written materials submitted to the Board does support the Petitioner because: The building changes the character of the premises as to its size (1 925 s.f.) and proposed use (repair and storage of 9 cars). The building also violates the Covenants in that it exceeds the 3 car garage limit imposed by the Covenants and is closer than 10 feet to the property line. 5. The Agency, Official, Board or Zoning District boundary should be affirmed. The issuance of Building Permit 09010003 to Rvan P Lewis should not be affirmed. 6. The work on the premises upon which appeal has been filed shall not be stayed because: The Stop Work order presently in force on the premises should remain in force because this project violates Zoning Ordinance 25.01.01.A.1 and the Covenants of the Johnson Acres subdivision. Oi /0512009 r~ , BZA Members: This will be my aresentation before you on March 23, 2009: My name is Howard Green. My wife Holly and I have been the property owners at 674 Johnson Drive in Carmel since 1993. I am speaking tonight on behalf of a group of neighbors present with me here to appeal the issuance of a building permit fora 9-car, 1,925 sf garage being constructed by Mr. Ryan P. Lewis at 646 Johnson Drive in Carmel. Those appealing with me are: John & Beryl Colosimo, 617 Carson Ct., Carmel, IN 46033; James and Laura Dunn, 645 Carson Ct., Carmel, IN 46033; Judy Wagner, 670 Carson Ct., Carmel, IN 46033; Michael & Susan Shaw; 706 Johnson Dr., Carmel, IN 46033 This project violates Carmel Zoning Ordinance 25.01.01 A. 1. which states, "Accessory buildings and Uses shat! not alter or change the character of the premises." Both the building itself and its use are in violation of this Ordinance. o The building itself violates the Ordinance in that it is hugely larger than any other accessory building in Johnson Acres or in any Planned Unit Development in the City of Carmel. It is inappropriate for a residential neighborhood. o As to its use, Mr. Lewis states that he has a collection of 9 cars that he intends to bring to the site for the purpose of repairing them. He also stated that he intends to allow others to use his building to repair and service their own cars The project also violates the Covenants of the Johnson Acres subdivision as a Planned Unit development. The Covenants are located in the Plat book of the Hamilton County Recorder's Office. The Covenants state: o In the 7th paragraph, "No structure shall be erected, altered, placed or permitted to remain on any residential lot herein, other than one detached single-family dwelling not to exceed two and one-half stories in height, and a private garage for not more than 3 cars and residential accessory buildings." Mr. Lewis states that he is constructing a building to store and repair his collection of 9 cars. In the 6th paragraph, the Covenants state: "No building structure or accessory building sha/I be erected closer to the side of any lot than 70 feet." The building is situated only 8' from the north property line. In the 18th paragraph, the Covenants state that "Right of enforcement of these covenants is hereby granted to the Carmel Planning Department." The Covenants were adopted by the Town Plan Commission on April 25, 1976. We are therefore appealing to the BZA tonight to have this building permit revoked and to have the building entirely removed. As you can see from the photographs, the building as it stands now, partially erected, is way beyond the size of any other garage or accessory building in Johnson Acres or any other Planned Unit Development in Carmel and stands out as an eyesore. Furthermore, the use of the building as a place to repair cars is in violation of the Zoning Ordinance which states: "Accessory buildings and Uses shall not alter or change the H. In that connection, we are also concerned about the noise and smell involved in repairing and storing this number of cars and the danger involved in storing gasoline, oil and other flammable fluids so close to our home. The courteous, customary and neighborly thing to do when undertaking a major renovation on one's property is to first share plans with the neighbors and try to address any concerns they may have. Mr. Lewis has done the opposite. He has misled us at every turn. o In the spring of 2008 when he began to cut down the beautiful big trees in his backyard, he stated he just wanted a big open grassy lawn o When he dug trenches to house the footers, he said he was just trying to improve drainage. o When he poured the footers he said he was just putting in a single width garage with added depth for a workshop. o We subsequently learned that Mr. Lewis had been planning this project for some time. His building permit application is dated September 25, 2008 and the construction plans he submitted with the application are dated December, 21, 2006. Further, Mr. Lewis told one of our other neighbors that he would not have purchased the property in January of 2008 if he had not believed he could construct this building. Mr. Lewis led us to believe that the garage was a recent idea and that it was to be much smaller than he was actually planning. o It seems clear that he knew that what he was doing was not going to sit well with the neighbors and he wanted to keep us in the dark until the building was up. o On Thursday February 12, one month to the day after the building permit had been issued, and shortly after the stud walls went up, Mr. Lewis came to our door, stated that he had spent a sleepless night worrying about the building. He stated that he was concerned about his reputation in the neighborhood and that he had decided that his building was too big for the neighborhood and that he had decided to make it smaller. He stated that he was going to take 20' off the rear of the building. He stated that even though he knew this would cost him an additional $15,000 that he wanted to do it. He urged us to reassure all of the neighbors that they didn't have to worry any more because he knew the building was too big for the neighborhood and that he was cutting it back by 20' o The next day -Friday Feb 13 - we observed the work crew carrying out these plans as Mr. Lewis had described to us the day before. o No work was done over the weekend. On President's Day, Feb 16, both my wife and I were off work and early in the morning we observed the 20' section being put back. We spoke to the workmen and they stated that they had been requested by Mr. Lewis to put the walls back up at their original 55' length. We spoke to Mr. Lewis about 1 hour later and expressed our concern and disappointment that he had reversed himself. He stated that it would be too expensive to make the building smaller, that it would cost $20,000 to make the changes because he would have to put in a new footing for the end wall in its new placement. We urged him to re-consider but he was adamant that he could not. (We later found out that this footer would not be necessary -Mike Hollibaugh told us that since the wall in question was an end gable wall and not a load bearing wall he would not have had to pour new footers.) Green Presentation to BZA March 23, 2009 --- Docket No. 09020014 --- rage z of 3 We want the Board to know that repeated efforts were made to express our concern about this project to the City: o About January 18 I called the City to see whether or not a building permit had been issued since none was on display anywhere that we could see. I spoke to someone in the Building and Code Services Department (I believe his name was "Bill") and asked whether a building permit had been issued. He assured us that there was indeed a building permit and stated that he would send someone out to check on the project to see whether or not it was being carried out in keeping with the permit. I stated to Bill that I could not understand how a permit for such a large structure could have been approved in Carmel. He offered no explanation and we ended the phone call. o At about this period of time our neighbors Beryl Colosimo and Susan Shaw also called Building and Code Services to express their concern about this project. They spoke with Pam Lux, I believe. They received the same message I had. We ultimately found out that about this time $ complaints had been received by Building and Code Services regarding this project. o The following Monday Feb 9, I emailed John Acceturo, our Councilman and Pam Lux in Building and Code Services to express our concern again about the scale of this project. Pam replied on Feb 10 that she would again have an enforcement officer look at the project. o On Feb 14 our neighbor Susan Shaw emailed the Mayor about the project and received a supportive reply from him. o At this point we began to call as many people as we could think of who might be able to advise us. We reached a County Council member who is a personal friend and he advised that we attend the Carmel City Council meeting the night of Feb 16 and ask to be heard during the public comments section of the meeting. o We did that and following my presentation, Mayor Brainard urged us to appeal this building permit and stated that he would consult with the City attorneys about what could be done about this matter. o A couple of days later a Stop Work order was issued on this project. We are here tonight to follow up on the advice of Mayor Brainard to appeal this building permit. In closing, this project, if permitted to remain, sets a terrible precedent for our Carmel neighborhoods. This building permit should be rescinded and the building removed because it violates both the Zoning Ordinances and the Covenants of our neighborhood. Thank you very much.
