requested at the scheduled Plan Commission Meefing.

Friday, November 12. Failure to submit Proof of Notice by this time will result

November 5. Failure to submit Informational Packets by this time will result in

Commission.

That part of lot 9 of Williams Creek Farms, A subdivision in
Hamilton County, Indiana, as evidenced by the plat they of
recorded October 22, 1979 in Plat Book 8, Pages 1, 2 and 3 in
the office of the Hamilton County Recorder as more particularly
described on Exhibit "A" attached here to.
Pursuant to Indiana Code 36-7-3-11, based on all of the evidence presented by the
Petitioner at a hearing held on _, 2004, the Plan Commission hereby approves
the Petitioner's Application to Vacate Plat, Covenants and Public Utilities for portions of Lots 10,
11 and 12b of Williams Creek Farms Subdivision, Plat Book 8, pages 1, 2 and 3 in the Hamilton
County Recorders Office (the "Lots") based upon a finding that:
1. Conditions in the platted Lots have changed so as to defeat the original purpose of
the Lots in the plat that the Petitioner seeks to vacate.
2. It is in the public interest to vacate the Lots within the plat.
3. The value of that part of the land in the plat that is contiguous to the Lots that is not
owned by the Petitioner will not be diminished by vacation.
