The applicant is requesting approval of a Development Plan and ADLS for the expansion of the Carmel Cemetery. Please see the informational packet prepazed by the applicant for an overview of the site. These reflect a substantial change from the plan originally proposed. It was apparent that the development for the US 31 improvements were not sufficiently progressed that any determination could be made by IDOT with respect to the actual needs for additional right-of--way. Therefore, the Cemetery Association agrees that the allowance of a 90 foot setback is appropriate at the present time. In future years, when the highway plans are more definite, and probably after construction, the Cemetery Association may want to revisit use of additional space along the US 31 right-of--way. In addition, the plans were modified to allow the 15 foot setbacks along the boundries with business districts. The Cemetery is requesting that the setback requirements for the southwest boundary (along the current Monon Trail) be reduced from the 45 feet required for a residential district to 30 feet. They are also requesting that the south setback (along the proposed Cool Creek Trail) be set at ten feet. The Cemetery Association will transfer the fee simple rights to the necessary right-of--way for the Cool Creek Trail to the City. A petition has been filed with the BZA for the set back waivers. With respect to the landscape plan, a concern was raised in committee about the use of white pines. The landscape plan submitted with this letter does not indicate a change. I have enclosed a letter from the Cemetery's horticulturist indicating that the location proposed for the white pines currently has a number of them growing and healthy. The Cemetery Association is willing to substitute with higher cost trees (Austrian Pine or Norway Spruce) if the Commission directs. It has been brought to my attention that the choice of using White Pine trees along U.S. 31 has raised some concerns by some board members. These concerns primarily consist due to the fact that White Pines tend not to be as healthy as other evergreen tree varieties especially in this area. While, I do not disagree that White Pine trees tend to have more problems in this area due to our soil, climate, and insects compared to other evergreen varieties. It has been my experience over the last twelve years that White Pines can still survive and thrive in our area, especially when planted with existing White Pines that are large and healthy. 't'his is and would be the case along U.S. 31 where there already exists many extremely healthy, full, and large (at least 20-25' high) White Pines trees. These trees have flourished in this area with no evident health or insect problems. This leads me to be very confident that planting additional White Pines in this area should not raise any concerns, and that these trees should survive and prosper just as [he existing White Pines have done for so many years. Any person desiring to acquire lots In the Cemetery shall conform to the terms and requirements of the Superintendent and Trustees But a partial payment shall not confer any title. ARTICLE II Section I. The proprietor of each lot shall have [he right to erect proper stones, monuments or sepulchral Structure strictly subject to the regulations governing the same. Section 2. All persons are prohibited from planting trees, shrubs or plants on lots or graves and will be prohibited from planting any flowers In the Cemetery grounds. They may decorate with flowers as [heir taste may dictate. Flowers are permitted In vases or urns and cut flowers may be Placed upon graves but will be removed as soon as they become faded and unsighfly in appearance. Section 3. If any trees situated In any lot shall, by means of their roots, branches, height or otherwise become detrimental to the adjacent lots, walks, or avenues or dangerous or inconvenient to passengers, It shall be the dory of [he Directors and they have a right to enter into said lot and remove the said trees or shrubs or such parts thereof as are thus detrimemal, dangerous or inconvenient. Section 4. Lots shall not be used for any other purpose than as a place of burial for the dead, and no trees within the lots or borders shall he cut down or destroyed without the consent of the Directors of the association. Section 5. If any monument, effigy or any strucNre whatever or any inscription be placed In or upon any lot which shall be determined by the major part of the Directors ro be offensive or improper or injurious to the appearance of the surrounding lots or grounds, the said Directors shall have [he right and it shall be their dory, to enter upon such got and remove the said offensive improper object or objects. Section 6. Proprietors shall not allow interments to be made in their, lots for a remuneration. Section 7. All deeds when executed shall be construed as simply granting to the proprietor of the lot conveyed [o the use of said lot for burial purposes for the interment of himself, his family, his relations and descendants and such other person as he shall have the permission of the Board to bury thereon as above provided. But such burial rights shall be personal to himself and the persons above named; and such rights shall not be transferable either by voluntary or involuntary conveyance, to any other person or persons without the express consent of the Board of Directors of the Cemetery. Private fences or enclosures around lots will not be allowed. Section 10. Trellises of any kind are prohibited on the grounds of the Cemetery. Section 11. No enclosures of any kind allowed around graves. Section 12. No trees, plants or shrubs In the corners of lots as boundary marks allowed. Section 13. Lot owners are prohibited from placing on lots or graves all toys, cases, boxes, globes, shells, can„ jugs, bottles and brie-a-brae of every description; any such article found on the Cemetery grounds will be removed, except as provided for in Article II, Section 2. Section 14. The grading of all lots must be under [he direction of the Superintendent, and by hands employed regularly on the grounds. ARTICLE III Section 1. The Superintendent is charged with the execution of these rules and regulations. It is of the utmost importance that there should be a strict observance of all proprieties due the place, whether embraced in these regulations or no[, as no impropriety will be permitted to pass unnoticed. All well disposed persons will confer a favor by informing the Superintendent of any breach of these rules that may come under their notice. ARTICLE IV Section 1. Only one stone may be placed at a grave, both head and foot stones will not be allowed. Section 2. Curbings around graves will not be allowed on the Cemetery grounds. ARTICLE V Section I. The Board of Directors are authorized to adopt any further rules and regulations that may be necessary to enable them to better and more efficiently conduct the affairs of this association. Section 2. The Superintendent shall be under the control of [he Board of Trustees and shall act only upon their advice and consent. Please accept this letter as support for the expansion of the Carmel Cemetery. As you may know, Dick Smith had been ill for the last few years and was unable to keep the cemetery in the condition he would have liked. The new caretaker Todd Andrews has done an outstanding job of removing bushes, trimming trees and making the cemetery a place we can be proud of again. I am very proud of the Veterans Memorial that has been placed at the entrance to the cemetery. It is very appropriate. My Mother, my Brother, and two Nephews are buried in the cemetery. I will be buried there in the near future. I sincerely believe our cemetery is in as good of shape or better than Crown Hill, Oak Lawn and etc. With the growth of this community, there is and will be a need for expansion of this cemetery. The enclosed site plans indicate a proposed 20-foot setback from the existing US 31 right-of--way. This appears to be noncompliant with the 90-Foot setback requirement in the CarmeUClay Zoning Ordinance (23B.8.1). While the preliminary plans for the US 31 Improvement Project would not impact the existing Cannel Cemetery, they do include construction extending potentially, 30 to 50 feet into the proposed expansion area. The 90-foot setback requirement would allow for the current proposed expansion as well as the potential for future improvements. Mitigation for any property required for the project will be pursuant to the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1964: United States Code Title 42, Articles 4601 through 4655 (42 USC 4601-4655), Uniform Relocation Assistance and Real Property Acquisition for Federal and Federally Assisted Programs: Code of Federal Regulations, Title 49, Subtitle A, Part 24 (49 CFR 24), Title VI of the Civil Rights Act of 1964, and Indiana State Relocation Assistance: Indiana Code Title 8 Article 23 Chapter 17 (IC 8-23-17). We have reviewed [he drawings submitted for this project and offer the following comments: GENERAL INFORMATION 1. The project site is currently located within curzent City of Carmel Corporate Limits. The following jurisdictions will apply. 2. Jurisdictions: • Street and Right of Way - City of Carmel (Range Line Rd.). • Water and Sanitary Sewer -City of Carme] • Storm Sewer/Storm Drainage -City of Carmel. 3. Board of Public Works and Safety Approval Requirements: • Water and Sanitary Sewer Availability. Does not appear to be applicable. • Commercial Curb Cu[. Does not appear to be applicable unless: -The existing curb cut will be modified or recons[mcted. • Temporary Construction Entrance. This does no[ appear to be applicable. • Any permanent improvement to be installed within dedicated right of way. • Consent to Encroach Agreements for any permanent improvement to be installed within dedicated easements and/or dedicated right of way. If an irrigation system is planned for this project, additional Water and Sewer Availability approval will be required from the Board and additional Water Connection Fees will be due. I am enclosing a schedule for Board of Public Works and Safety meeting dates and agenda deadlines for your use. Please use the Engineering Department deadlines for submissions to the Board. Any submission to the Board requires prior ftua! approval by the Carnte[ Clay Plan Commission anrUar the Board ojZoning Appeals and completion of review by the Technical Advisory Committee. Final drawings will not be approved for construction until all issues have been resolved. All Carmel Utility issues must also re resolved. The design engineer must certify all drawings submitted for final approval. This office will require a minimum of five-sets (maximum of seven-sets) of approved drawings afrer all issues have been resolved. The drawings will be stamped approved and signed by both the City Engineer and Director Carmel Utilities. Our Public Works Inspector will receive one-set and one-set will be maintained in the Department of Engineering. If more than the minimum five-sets are requested to be approved, the additional sets (maximum total of two additional) must be submitted with the five required sets. 5. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated easements and/or right of way will require a Consent to Encroach Agreement between the Owner/Developer and the City of Carmel. This Agreement requires Board of Public Works and Safety approval. Installations within dedicated right of way require separate Board approval. A copy of our Residential Subdivision and Commercial Irrigation System Requirements are available upon request. 6. Carmel Utilities does not subscribe to "Holey Moley" and should be contacted directly for al] water main and sanitary sewer main locations. 7. Cannel Utilities will provide a separate review of this project regarding water and sanitary sewer issues. 8. I am including copies of the following with this correspondence: • Pemut Data, Contacts, etc. • Commercial Peanitting Procedures. BONDING REQUIREMENTS 9. Upon initial review, i[ appears the following bonding requirements may apply to this project: Performance Guarantees Performance Guarantees maybe required if the owner is required to construct paths and/or sidewalks with [his development. If [his is the case, we require a Certified Engineers Estimate for 100% of the cost of labor and materials to construct the path and/or sidewalk. Performance Guarantees may be Performance Bonds or Certified Checks. Street Cut/Right of Way Permit and Bonding Requirements Any work in the dedicated right of way of Range Line Rd. will require a Right of Way Permit and a License and Pemut Bond. The bond amount will be determined by the number of instances of work in the right of way (curb cut, storm sewer work, etc.) @ $2,000.00 per instance. Open pavement cuts in dedicated streets require approval by our Board of Public Works and Safety. Right of Way Pemvts and information may be obtained from Fred Glaser, Right of Way Manager, Department of Engineering. PROJECT COMMENTS 10. Is it the intent of the developer for the streets within [he cemetery [o be contained in dedicated public Right of Way? Right of Way lines have been indicated on the development plans making it appear that this is the case. 11. Normally a development such as this would be required to dedicate Right of Way in accordance with the Thoroughfare Plan (in this case a 45' half is required). In addition, [he developer is required to construct sidewalk or multi-use path along its public road frontage in accordance with the Alternative Transportation Plan (in this case a 10' multi-use path is required). 12. The proposed easement along the south property line should be described as a Utility and Public Pedestrian Easement and at a minimum, needs to have a width of 25 feet. Additional easement width will be required where [he proposed easement meets the Monon Trail Right of Way. 13. Typically the developer is responsible for the constmc[ion of any Alternative Transportation Path that may 6e indicated on the property of the proposed development by the Alternative Transportation Plan. This means that the Carmel Cemetery Association would be responsible for the construction of approximately 350 feet of the Cool Creek North Trail along their south property line. Mc Ronald L. Bussell May 19, 2003 Page 3 14. Typically all paved areas constructed with a development are required to be curbed with storm sewers provided. 15. It appears tharthe U.S. 31 Overlay Zone has been ignored. What is the justification behind this? The above comments are based upon the Engineering Department's initial review. Please provide our office with a follow up letter regarding this review and revised plans, indicating all revisions. It is critical that our office be made-aware of all modifications made on the plans being re-submitted, particularly if any such changes are considered "new" or fall outside of our initial review. It is evident that the Cemetery Association is seeking a significant level of relief from Ordinance requirements necessary for them to achieve approval of a revised proposal as outlined below. I have listed the Ordinance requirements where relief is necessary and noted an alternative the Department can support in this regard: Setbacks for grave sites (vaults): a, Along US 31 Right of way: 90' required 20' proposed You will need to file a letter with IDOT regarding this proposal. If they do not file objection to the plan the Department will support this request for relief. b. Along west and faz south property lines: 45' required 30' proposed As you proposed you client desires to dedicate an area along the south property line to the City for the construction of the ATP Trail. If this area is between 20' and 45' +/- song the south property line it would occupy the location of the ATP Trail resolve the requirement to construct the trail. In addition the Department would support a 0' setback request along the new property line. We would also support an even further reduced setback from the west property line down to 20' in width. This would allow your client to recover any plots lost along the south property line. c. Along south property line adjacent to commercial: 15' required 10' proposed The Department wiU support this request for relief. identify construction of path per Altemative Thoroughfare Plan (ATP): a. Provide connection to ATP path from Monon, developers aze required to construct paths per the ATP plan. Not shown on plan. If your client deeds over the area where the trail is to be constructed then the obligation for its construction falls on the city. The site must comply with the buffer yard requirements along all but the US 31 exposure. Without the benefit of a Landscape Plan the Department has indicated that they will support reductions in the required width of Buffer areas. b. A 30' buffer is required along the US 31 right-of--way line planted with 8 trees and 15 shrubs (or 3 evergreens) per 1001ineaz feet of frontage. In general it is their desire to approve the granting of an easement to the City for purposes of a new water main and an extension of the Monon Trail. However, they see this step as a part of an overall development plan for the improvement of the undeveloped land which is now a part of the cemetery and the City in meeting their needs. It is their purpose to be cooperative with the City (and State?) in meeting present and future needs of the community-which includes the provision of badly needed additional cemetery space. Therefore, the areas of discussion are as follows: 1. The Association grant the easement along the border of the cemetery property, with the easement to be 20 feet as granted easement. With an an additional 10 feet of clear space on the cemetery side of the easement, this will result in a loss of 156 grave spaces per the original proposed plat. Their loss of revenue (income from sales and opening less expenses will be about $950 per grave site-or $148,200). They are willing to give the easement at a cost of $25,000. 2. The Association would like some sort of agreement from the City that it would support the submission of a revised proposed plat for approval, with the following variances: a) Setbacks along the easement would be limited to the easement plus 10 feet. b) Green space along US 31 would be 20 feet from the current US 31 right-of--way. This space is physically well below the highway grade and not visible from • the highway. It currently has a number of trees. This requirement would not be adjusted if a subsequent agreement is made with INDOT for the right to grade future construction into the greenway. c) The cemetery be given a tap into the water line a some point along the easement. d) The City erect a fence similar to the current fence along the Monon Trail, between the extension and the cemetery. e) The proposed roads for the new portion of the cemetery be 18 feet in width (current is 16 feet) and not be curbed. f) The easement agreement be modified to provide No access for others to use cemetery property for hook-ups maintenance or any other purpoes. Indemnification by the City for any claims, injuries, etc. resulting from their use of the trail and extension.
