MEMBERS PRESENT:
Mayor James Brainard, CouncilP.resident W. Eric Seidensticker; Council Members-Richard.L. Sharp;
John V. Accetturo, Luci Snyder, Joseph C. Griffiths, Kevin Rider, Clerk-Treasurer. Diana L. Cordray and
Deputy Clerk-Treasurer Lois Fine.
Councilor Carter was riot in attendance.
Mayor Brainard called the meeting,to order at 6:02 p.m.
Reverend Luther Brunette, Carmel Lutheran Church, pronounced-the Invocation.
Mayor Brainard.led the Pledge of Allegiance..
1 RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
There were none.
APPROVAL OF MINUTES:
Councilor Griffiths tirade a motion to approve. Minutes from the February 1.6, 2009 Regular Meeting.
Councilor Rider seconded. There was no Council discussion. Council. President Seidensticker called for
the question. Minutes were approved 6-0.
RECOGNITION OF PERSONS WHO WIS13.TO ADDRESS THE COUNCIL:
Ed Pipkin, 942 Aurnan Drive West, Cartel; TN., addressed the Mayor's"stimulus"package requests and
provided the Council with a handout (attachment 1).
Allichael Long, 1-1297 Oldfield Drive; Cannel; IN., President of the Carmel Community Players; addressed
the Council regarding Support for the Arts and Ar-ts'funding.
Marnin Spigelman, 11816 Harvard Lane; Carmel, IA!, addressed CouncilorSharp's.speech at the last
Council meeting referring to the Mayor as "recklegs" in regards to spending and discussed the
1 527,750,000 Bond ordinance pending before the Council.
COUNCIL, MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
Councilor Snyder briefly: reviewed a report provided to the Council of the 2008 projects assisted by the
Hamilton Council Alliance.
Councilor Acceauro discussed concerns of the cost for the 116`x' & Carmel Drive Keystone Avenue
project. Councilor Accettuto also asked for clarification from American'Stucturepoint regarding the
engineering estimate that was provided'ahthe-February 25, 2009 special Finance.Committec meeting.
Mayor Brainard discussed the drainage issues and projects that were addressed at the last Council
meeting. Mayor Brainard also addressed the Keystone'Avenue project and the article thatappeared on
Saturday, February 28, 2009 in the Indianapolis Star.
Councilor Sharp addressed the Mayor regarding the Keystone Avenue project funding.
ACTION ON MAYORAL VETQES:
There were none.
CLAIMS:
Councilor Snyder made a motion to approve claims in the amount of $4,534,810.59. Councilor Rider
seconded. There wa"s zio Council discussion. Council President Seidensticker• called for the question.
Claims were approved 5-0 (Councilor Griffiths abstained).
COMMITTEE REPORTS:
Councilor Snyder reported that the Fihance,,,Adntihistration.and Rules Conunittee.inet on February 19,
2009 and discussed Ordinance D-1926-09 which was forwarded to the Council,with a proposed
amendment. The Committee also discussed Ordinance-D=1927-09 and;requested,from various entities
additional information to be attached to the:Bond ordinance'thatsupport 'each project requested. This
item remained in committee. The Committee-met on,February 25, 2009 to discuss and review the budget
for the Keystone Avenue project. A presentation was_ made by Rick Conner, President of American
Structurepoint. The next meeting will be held on3Tluinday, March 1.9,.2009 at 5:30 p.m.
Councilor Sharp reported that the Land Use, Annexation and Economic Development Committee met and
discussed Ordinance Z-526-09 which was forwarded with a favorable recommendation to the Council
with a proposed PILOT Agreement. The Committee also discussed, Resolution CC-12-15-08-03 ("C3
Plan") which remains in committee: The next meeting;will be lield on Thursday, March 12, 2009 at.5:30
Councilor Rider reported that the=Parks, Recreationand . Arts Committee had not met.
Councilor Griffiths reported that the Utilities,'Transportatiori and Public,Safety Committee had not met.

Harmer. There was brief Council discussion-

Council President Scidensticker.announced the'Third Reading'of.Ordinanee p-1926-09;;An Ordinance
ofthe Common Council of the City of.Carmel,.fndiana, Establishing.a Non-Reverting Worker
Compensation Self-Insurance Fund #302 (Section 2.133). Councilor Snyder addressed the Council-and
made a motion to move into business for discussionpurposes,Ordmance D-1926-04 As Amended and to
add Section 6. Mrs. Snyder then read the'veibiage. Councilor Griffiths-seconded. There was no Council
discussion. The motion to amend was approved 6-0. Councilor Grifftls made a,motion to approve
Ordinance D-1926-09 As Amended. Councilor Sharp seconded. There was,no Council discussion.
Council President Seidensticker called for,the'vote. Ordinance D-1926.09 As Amended was
adopted 6-0.
Council President. Seidensticker announced the Second Reading of Ordinance D-1927''=09; An
Ordinance of the Common Council of the City of Carmel, Indiana, Approving a Lease Between the City

Council President Seidensticker announced the Fourth Reading of OHidance Z-526-09; An Ordinance
of the Common Council 6f-the City of Carmel, Indiana, Amending Ordinance Z, 500-06 As Amended by
Ordinance Z-521-08 (Park Place PUD). Councilor Sharp addressed the Counctl,and read the final
proposal for The Barrington of Cannel PILOT Agreement that was provided by Dave,Coots: Councilor
Sharp made amotion to approve ,Z-'526-09 conditioned on the. commitment to the PILOT Agreement as
outlined in the document presented by the developer. Councilor Griffiths seconded: CounciiorSharp
made a motion to amend Z-526-09 to attach'the final proposal for The Barrington of Carmel PILOT
Agreement modification one (I) as.submiited by the, developer, it will-become Exhibit B. Councilor
Rider seconded. There was no Council discussion. The motion was'ap"proved 6-0. Councilor Sharp
made a motion to approve Ordinance Z-526-09 As Amended. Councilor Griffiths seconded. There was
no Council discussion. Council PresidentSeidensticker called lorthe vote. The motion was approved
6-0. Dave Coots, Attorney for the petitioner, addressed the Council.. Clerk-Treasurer Diana.L. Cordray
addressed Mr. Coots. There was brief Council discussion. 'Councilor Sharp made amotion to reconsider
Ordinance Z-526-09 As Amended. Councilor Rider seconded. There was no Council discussion. The
motion to reconsider Ordinance Z-526-09 As Amended was approved 6-0. Councilor Sharp made a
motion to approve Ordinance Z'526=09 As.Amended based uponxeceipt of a:certifled copy of the
modified commilments prepared by the developer and by Mr. Coots as an attachment to Ordinance
Z-526-09. This ordinance and attachments shall.be delivered to the Clerk-Treasurer's office. Councilor
Rider seconded. There was no Council discussion. Council President Scidensticker called for the vote.

Utilities, Transportation and Public?Safely'Coininittee for further review and -consideration.

Looking at the Mayor's proposed list of ready stimulus projects

I do not wish to go into the projects listed. I would.like to call your
attention to a project that is not listed.
In 1967, the neighborhoods called Aurrnan & Newark were annexed
into the Town of Carmel. (Per Hamilton Co 11/221/67 ANNEXED).
During the Court Case Homeplace V City of Carmel, The City of
Carmel stated they would have to spend a great deal of money to
bring the streets up. to city standards.. There has been mentioned
Chesterton (annexed 12/2005) was in need of updating- of roads and
drainage. I am sure others are in need.
In the 42 years Auman and Newark have been apart of the City (or
Town) of Carmel, little has been dune to address the streets and
drainage. A plan was proposed
(http://cocdocs.ci.carmel.in..us/Weblink/Browse.aspx) and never
implemented.
Streets, sidewalks & drainage are not glamour issues. Most of the
time the unglamorous projects are pushed to the bottom of the pile..
This is a proper and required part of the city's responsiblitys.
