Docket No. 78-03 PP Amend; (03050038); The Lakes at Hamilton Place (Formerly: Eagle Ridge Subdivision) The applicant is requesting approval of an amended a previously approved Primary Plat. The petitioner also seeks approval of the following Subdivision Waivers: 78-03a SW (03050039) SCO 6.3.20 private streets 78-03b SW (03110041) SCO 6.3.7 cul-de-sc length 78-03c SW (03110042) SCO 6.3.1 street centerline offset 78-03d SW (03110043) SCO 6.3.15 street centerline radius 78-03e SW (03110044) SCO 7.1 standard open space requirement The site is located on the north side of West 116th Street, 1/4 mile east of US 421. The site is zoned S-1/Residence -Estate. Filed by David Sexton of Schneider Engineering for Dura Development, Inc. This subdivision was approved in 1998. A short time later Section one of the Subdivision, then known as Eagle Ridge, was approved but never constructed. Earlier this year the owner expressed a desire to move forward with their subdivision plans. At the request of the Department the owner submitted a revised layout. You will find both the new and original layouts in your information packet. This revised layout was takeri to the Executive Committee of the Plan Commission who also serves as the Plat Committee. They approved the revised design as an acceptable Secondary Plat layout and the owner has proceeded with construction plans for sections one and two of this new layout. These sections include the majority of lots west of West Road and the area south of the existing lakes. In September of this year the applicant appeared before the Plan Commission with a request to make a portion (24 of the 214 lot served by private streets). At that time members of the Commission expressed concern not with the modifications to the approved plat but with the use of the Executive Committee process employed to address the change. Since that time the subdivision waiver request has been tabled at committee. This Public Hearing on the above listed waivers and Primary Plat Amendment will allow the full Plan Commission to review the modifications with the benefit of public input after the public hearing is conducted. Information concerning the subdivision waivers that address the changes between the original Primary Plat and the amended one are contained in the packet. The Department recommends that the Plan Commission forward these items to the Subdivision Committee for further discussion on January 6`h PCR-2003-1216
