The Lakes at Hamilton Place (Formerly: Eagle Ridge Subdivision)
The applicant is requesting approval of an amended Primary Plat to allow a private street.
The site is located on the north side of West 116th Street, 1/4 mile east of US 421. The
site is zoned S-1/Residence -Estate. The petitioner also seeks approval of the following
Subdivision Waiver:

The applicant is proposing to gate and make private a portion of the streets in the Lakes at
Hamilton Place subdivision. The subject street system serves 241ots within the 214-lot
subdivision. Please see the petitioner's information packet for a layout of the site. One
subdivision waiver is necessary to allow a private street in addition to the Primary Plat
Amendment.
This subdivision was approved in 1998. Section one of the Subdivision, then known as Eagle
Ridge, was approved but never constructed. Eazlier this yeaz the owner expressed a desire to
move forward with their subdivision plans. At the request of the Department the owner
submitted a revised layout. This is the layout you will find in your information packet. This
revised layout was taken to the Executive Committee of the Plan Commission who also serves as
the Plat Committee. They approved the revised design as an acceptable Secondary Plat layout
and the owner has proceeded with construction plans for sections one and two. These sections
include the majority of lots west of West Road and the area south of the lakes that is the subject
of this request.
Private streets are under subdivision waiver review and aze subject to Plan Commission approval
on a case-by-case basis. In general, the Department dose not support private streets. However,
the applicant has illustrated that all streets within the subdivision will be constructed to public
standards, the proposed private streets will serve a limited number of lots (24), and there is a
unique distinction between the product areas outlined within the subdivision. These issues
warrant consideration in determining the availability of private streets as an option.
Opposition was heard at the public hearing concerning the location of the entrance. In addition
there were questions regarding the notice and previous approvals. The Department will address
these at the meeting.
The Department recommends that the Subdivision Committee forward this request to the
full Commission after all comments and concerns have been addressed.
