EXECUTIVE COMMITTEE
FRIDAY, DECEMBER 19, 2003
The Executive Committee of the Carmel/Clay Plan Commission met in the Department of
Community Services Conference Room of Carmel City Hall at 2:00 PM on Friday, December 19,
2003. Members present: Marilyn Anderson, Dave Cremeans, and Leo Dierckman, thereby
establishing a quorum.
Mike Hollibaugh, Director, and Jon Dobosiewicz attended the meeting on behalf of the
Department. In addition, John Molitor, Legal Counsel, was present.
The Committee re-Ordered the Agenda to hear Item 3 as the first item of business.

The Lakes at Hamilton Place (Formerly: Eagle Ridge Subdivision)
The applicant is requesting approval of an amended a previously approved Primary Plat.
The petitioner also seeks approval of the following Subdivision Waivers:

The site is located on the north side of West 116th Street, 1/4 mile east of US 421. The
site is zoned S-1/Residence -Estate.

Charlie Frankenberger. appeared before the Executive Committee representing Dura
Development. Paul Shoopman, Emie Reno, and Craig H. Lintner were also present.
Charlie Frankenberger gave a brief history of the amended primary plat and related subdivision
waivers. At its meeting December 16, 2003, the full Plan Commission refer-ed this item to the

Executive Committee, excluding the Subdivision Waiver for private streets. The Plan
Commission also delegated full authority to the Executive Committee to approve the amendment
to the Primary Plat and the waivers, excluding the private streets.
Jon Dobosiewicz said the Department had no concerns. There was concern on the part of one of
the neighbors regarding the walking trail. The walking trail is viewed to be a benefit to other
families in the area as well.
Charlie Frankenberger pointed out that Mc Sweeney, area resident, was in attendance at the
meeting on the 16`h of December and did not remonstrate. There are no outstanding issues.
Dave Cremeans moved for approval of Docket No. 78-03 PP Amend, The Lakes at Hamilton
Place (Formerly Eagle Ridge Subdivision,) including the following Subdivision Waivers:
78-03b SW, 78-03c SW, 78-03d SW, 78-03e SW, seconded by Leo Dierckman and
APPROVED 3-0.
1. Resolution regarding the exercise of Planning and Zoning Jurisdiction over
Contiguous Unincorporated areas of Clay Township
The consensus of the Committee was that it was better to approve this now than to have the
Township exposed to the County and "open zoning" that the County is not prepared to handle.
Jon Dobosiewicz confirmed that approving this course of action, in effect, breaking the Joinder
Agreement would allow 11 members on the Plan Commission and two from the area outside the
City limits.
Dave Cremeans moved for approval of the Resolution regarding the exercise of Planning and
Zoning Jurisdiction over Contiguous Unincorporated areas of Clay Township, seconded by Leo
Dierckman and APPROVED 3-0.
Proposed Amendments to Rules of Procedure
a) The Commission will be able to designate and appoint the Executive Committee as
the Plat Committee pursuant to Indiana Code which allows them to make modifications on the
Secondary Plat if no material changes occur. However, the Executive Committee may act under
this provision ONLY if the petitioner has given notice for the requested change 25 days prior
rather than 10 days prior.
b) Under "Repeal," the language would change to "Replace" rather than Repeal.
The Executive Committee also discussed removing members who do not attend meetings for an
extended period of time; John Molitor referred to a precedent in the State Statute (IC 36-7-4-220
paragraph c). An appointed member who misses three (3) consecutive regular meetings of the
metropolitan development commission shall be treated as if the member had resigned, unless the
appointing authority reaffirms the member's appointment.
