Docket No. 79-03 PP Amend; (03050040); Treesdale Subdivision The applicant is requesting approval of an amended Primary Plat to allow a private street. The site is located on the east side of Towne Road, 1/2 mile south of 106th Street. The site is zoned S-1/Residence -Very Low Intensity. The petitioner also seeks approval of the following Subdivision Waiver: 79-03a SW (03050041) SCO 6.3.20 private streets Filed by Paul G. Reis of Drewry Simmons Pitts & Vornehm for Lucky, LLC. The applicant is proposing to gate the existing street that serves the Treesdale Subdivision and in the future upon completion of the section two of the subdivision also gate the other entrance. Please see the petitioner's information packet for a layout of the site. The applicant is proposing one subdivision waiver necessary to allow a private street. This subdivision was approved in 2000 and subsequently section one was constructed in 2002 (see informational packet). Last fall construction of the columns for the gate was started. Notice was set to the developer by the Hamilton County Highway Department indicating that the columns encroached into the right-of--way and needed to be removed. Time passed and the columns were completed. This petition was filed and the Highway Department indicated they would delay enforcement action pending the result of the Plan Commission's decision. The Department dose not support private streets. The applicant needs to make the case that there is something unique here that warrants special consideration. If there is, those items may help to establish a process and standards within the Ordinance addressing the availability of private streets as an option to developers when a project comes in. The Department recommends that the Plan Commission suspend its rules following the public hearing on the Subdivision Waiver and Primary Plat Amendment and vote on both this evening. This is provided no comments require further discussion at committee. Note: Written findings are required for action on the both petitions.
